I have a quick question for one of my friends who is also filing for his wife in few months time. His wife had overstayed under her previous passport that had her name before married. However, now they have new passport that has the husband name. Now he wants to apply as married couple to USA but not sure if this will create any problem as she went back to her country last year in August 2007. They are applying for K3 or CR1 for USA.

Any advice. would this create problem at the usics, nvc, or at the embassy.

The overstay will matter, just because it happened on a different passport/ name does not mean it will be ignored. The implications depend on how long she overstayed, how she entered etc.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
