I -130 Please help...

THIS IS A REPEATED POST I AM NOT FAMILIAR WITH THIS FORUM MY APOLOGIES, PLEASE DIRECT ME WHERE I SHOULD POST THIS IF THIS IS THE NOT THE RIGHT CATAGORY FOR MY QUESTIONS.

Dear friends,

This is the only place I found useful after searching the whole WWW for days ... I am hopping someone could respond or be able to answer some of my questions.

1. I applied as unmarried son over 21 on march of 2006 (My mother applied for me)

2. got approved and they asked me to wait for visa availabilit.

1. Have an approved H1B for the Oct of 2008.

My questions are:

1. How long will it take before I be able to get a green card on I-130... I am just sick and tired of being here on F1 visa I have been here for 10 years now is there any other case I could at least get a green card.

2. I am on the verge of getting married, unfortunately I found my dream girl to be in Canada.. now do I have to wait until I get a green card to be able to marry her ... I am totally lost here... Love her, but can't marry her cuz of this situation.

3. I have applied for H1B visa, and it is approved, my employer's Lawyer will perhaps get it on Oct 1. of 2008. however there is a catch this is one of those darned consulting companies, they want to make a fortune over this, and they target WAY HIGHER than they should to satisfy their filthy-selves.

If I am not able to find a decent job they perhaps will cancel my H1B. . Now the Consulting Company perhaps will never give me the approval notice or the digits to transfer it to any company... what should I do in this case?

Give me some options guys, PLEASE HELP ! :(

What's the priority date for your I-130?

Unmarried son over 21 will usually wait a few years for visa number.

Which country are you from? That's one factor determines how long you have to wait for your visa number too.

Hope someone else comes along to answer your questions on H1B.

07/11 Congress aide found out I-130 was approved on 07/09!!!

07/17 NOA2 hardcopy dated 07/09

07/21 Approval notice hardcopy dated 07/11 I-130 was approved in 116 days from filing date (expedited).

07/15 NVC received and assigned case #

07/16 Emailed expedite request & supporting documents

07/17 DS-3032 and AOS fee bill generated, Emailed DS-3032.

07/21 Received DS-3032 & AOS fee bill hardcopy.

07/24 NVC approved expedite request

US Consulate

07/31 Package arrived at US consulate

08/01 Was told to pick up packet 3 on 08/04

08/04 Req packet 3 send by mail.

08/09 Received packet 3

08/11 Returned packet 3

08/15 Picked up packet 4 & medical check up

08/28 Submitted civil docs & paid $400 IV fee. Visa Interview & approved !!!

08/29 Visa in hand

09/30 POE IR1 visa interview took 166 days from the I-130 filing date (expedited).

10/04 Applied for SSN in married name.

11/11 Welcome notice received (dated 11/04)

11/15 Received Green card.

11/21 2nd Welcome notice received (dated 11/13)

11/24 Received SS card in maiden name.

I think the visa availability goes by date posted in this link

For unmarried children I think its family 1st category april 2002 (those who applied in april 2002). If you get married you will go to family 3rd category and vsia availabilty date is June 2000. I think you & your wife will get gc once visa becomes available.

Pseudo: You can try getting getting it thru your employment H1 B visa (ask your employer to file your gc). It can take 4 to 5 yrs. But your wife can come to usa on depenedent h4 visa. Call a lawyer or uscis and ask if you can keep your earler family gc application and still file a gc appln thru employment.

Pseudo: If your to be wife is canadian citizen, she can get you a canadian pr once you get married and you both can wait the gc family process out in canada. I think you can marry her but you might goto family third category (you can ask uscis if they will use your same pettition and you dont need to refile again, just send marriage updates).

Pseudo: Dont know need to stick with these companies for gc or do a h1 transfer to a compnay that does gc filing .

Pseudo:Not sure, I'm sure you can transfer your H1B. Dont speculate some much into the future.

Pseudo: You can move on with your life (come h1b, get married, get ur wife to usa on h4 depenedent visa or move to canada all together) and wait out the family gc process. Or file a gc thru your h1b employer who ever it is (even the h1 transfer). hope this helps.. verify with others too.

Facts are cheap...knowing how to use them is precious...

Dear friend,

how will it work if I come to Canada, how long will it take for me to be able to work and/or to get a travel document, since I do have an elder mom and a young brother (both US citizens) whom need me.

My wife to be is a permanent resident who lives in Canada what could be done... please help.

Your canadian pr to be wife can apply for candian pr for you after marraige I think it takes 3 to 6 months to get canadian pr. If you want to go to the US (live & work) you would still need a H1B visa again you can get a h4 dependent visa for your wife to live in the US she will not able to work. I don't think you will get a b2 visitor visa for US as that could be considered intent to immigrate (as you have a gc appln pending and family ties in the US). Also do seek counsel of a lawyer.
