My mother in law is here for the summer on a B1/B2 tourist visa. Her visa is valid until 15 October and the return flight is scheduled for 27 September. However, her I-94 is stamped as valid until 19 September.

What should we do? Will she have a problem getting another visa next year if this isn't resolved?

Leave before her I 94 expires.

Most unlikely to get anothger visa if she overstays.

BIG BIG BIG DEAL! Please DO NOT let her over stay her I-94. If you have a way of changing her plans and leaving before it expires do so. You never know what the future holds and how the US Immigration Laws may go in the future. Therefore for her own good and guarantee that she won't have problems in the future, I would change the flight and leave before it expires.

08/29/08 - Notice of Rejection of 797C Fee (Sent in extra money - money order mailed back.)

Fee waived for I-765 application when filed concurrently with I-130 and I-485.

08/30/08 - Biometrics Apt Notice received

09/13/08 - Biometrics completed and picture taken

11/05/08 - EAD card production ordered

11/07/08 - Received I-485 Interview letter

11/10/08 - EAD card production ordered (again)

11/13/08 - EAD approval notice sent

11/14/08 - EAD arrived in the mail

11/21/08 - I-130 touched and I-485 finally shows up online

01/16/09 - Second Appointment to review application -- APPROVED! :-))) YAY!!!

01/16/09 - AOS card production ordered - E-mail from CRIS

01/22/09 - AOS card production ordered (again) - E-mail from CRIS

01/23/09 - AOS touched

01/24/09 - Received Welcome to the United States letter and approval notice for I-130

01/28/09 - AOS Approval Notice sent - E-mail from CRIS

01/29/09 - AOS touched

01/30/09 - GC arrived in the mail

11/16/10 - Form I-751 filed (Petition for Removal of conditions)

11/19/10 - Application received at VSC

Hi,

If you want you can apply for an extension for another 3months or so but you will pay like almost $400.00 including biometrics..

My mom is also on a B1/B2 and we are going to apply for an extension hopefully she will have another 6months. We don't want to mess her record since she got a 10yr multiple visa entries.

Unless your mother needs to extend because she has encountered medical problems or is hospitalized, you can count on the extension being denied. They don't grant extensions just because you want to stay longer--there needs to be other reasonable justification.

I have similar situation with my youngest kid (9 months old).. She had stamped on I-94 that she is allowed to be in USA till Dec 6 2008..

We (whole family) entered together a month ago and we showed return tickets for all members.. (which is planned for Dec 13 2008).

I was allowed to stay till Dec 13, my wife too.. My older kid till May 2009.. and my youngest one till Dec6 (DAMM, why.. )

What to do.. should I fill I-539 and pay 300usd.. I probably would spend more if I want to change flight dates..

or ignore it, hoping that this few extra days will not matter.. It is obvious mistake from immigration offices.. and I did not check it, right at his desk.. My Bad

Any advice appreciated.

Go back to the airport?

With regards to the the extension it depneds on whether you have any plans to come back to the US. If you do not you have nothing to lose.

I can go back to airport SFO.. but I doubt they let me in to see immigration officers.. ??? I doubt.. it is in no-where land..

Most Airports you can, I have been through SFO once but for the life of me can not remember the lay out.
