Our joint sponsor, filled his tax retuns in 2005 as married, but in 2006 & 07 he filled as single. He got divorced in 2006 I guess. Anyways, do we need to attest his divorce decree too while sending our AOS?

Also our lawyer is asking other silly things, which I haven't seen anywhere, things like joint sponsors --> passport, his driving license, his son's birth certificate (his son is in the household) & the divorce decree.

Also we do have our joint sponsor's 1040, but not the w-2s, are the w-2s necessary?

I guess he wants to back up on the number of dependents.

Page 11 of the I-864 (right after all the instructions) has a checklist that states what is needed from each filer. You can check what your joint sponsor needs. The passport makes plenty of sense since the joint sponsor has to prove US citizenship or residency. The other stuff, you'll need to check that, but my opinion is that you can never be too prepared for the NVC. :D

Filed I-130 via CSC in Feb 2008. Petition approved June 2008. Consular interview in Mexico, Oct 2008, visa denied, INA 212a6cii. We allege improper application of the law in this case.

2012, started over in Seoul: I-130 filed DCF on 7/2, I-130 approved 8/8, Medical at Yonsei Severance 11/20, IR1 appointment in November 2012.

Joint sponsor needs to proof his citizenship. So, the passport makes sense.

His son's birth cert is proof of his dependent(s).

You do need 1040 AND W2. Or you can use tax transcripts.

The lawyer may be playing safe and try to cover every possible RFE with more documents, but one can never be too prepared for immigration. :-)

Joint sponsor does have his birth certificate, isn't that enough for citizenship?

No, we wouldn't need i-864a, he is a friend of my husband, so we aren't in the same household.

Opps sorry, time for me to bite my tongue back :blush: . Yes you are right, if he was still married his wife might had to fill up i-1864a . Sorry about my earlier falseg judgement
