Hi everyone!!..first of all I'd like to thanks all of you at VJ for making this the best immigration resource on the web... :thumbs: ..I'm new here but I've been reading the forums for months and they really helped me with all the forms,laws,etc... :wacko:

I'm getting all the forms together for an AOS+I130 and I have a question about the I864: my wife (USC) has been working abroad for the past two years,she moved to Europe two days after graduation,so she's showing no US income for the past three years,only the income from abroad that is not taxable as she meets all the requirement....she now has a job here in the US since July and she's making around 30/40k a year,so well above the poverty line. I have the tax returns plus a letter from her employer (saying she's full time+since when+pay),her contract explaining salary and commissions and three pay stubs...is it gonna be enough or do I need a joint sponsor??

Hope someone is gonna give me some advice... :help:

Looks like it would be better to get a joint sponsor.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

I guess i answered myself this question while reading the USCIS handbook...

USCIS, however, may consider other evidence of income (e.g., pay stub(s), employer letter(s), or both), if (1) the sponsor establishes that he/she was not legally obligated to file a Federal income tax return for the most recent tax year, or (2) USCIS determines that the income listed on the Federal tax return for the sponsor’s most recent tax year does not meet the governing threshold.

In other words, if the sponsor’s current income is sufficient, it can establish that the Form I-864 itself is sufficient even if the tax return without any other documentation might warrant a finding that it is not sufficient. For example, if the sponsor recently started a new job (that USCIS is satisfied will likely continue) and the income from the job now meets or exceeds the legal requirement, USCIS may find the Affidavit of Support to be sufficient, notwithstanding information included in the transcrip t or copy of the tax return(s).

My husband worked abroad and earned foreign income during 2006 and 2007. We submitted the US tax returns for those two years plus evidence for current income (US based). So far, this seems to have been accepted.

This should be ok. She has enough current income so why worry about a joint sponsor. Your supporting documentation seems good. I would just add more paystubs if you have them or can get them. Do you have US tax returns for your wife for the 2 years she worked aboard? She is required to file them even if the income is tax exempt. If she has them, and the income is above poverty line, include those too.

This should be ok. She has enough current income so why worry about a joint sponsor. Your supporting documentation seems good. I would just add more paystubs if you have them or can get them.
