My 130 and 129f were approved on 8/11/08 .NVC assigned case number for 130 on 8/13/08.I called few days ago to cancel k3 route . they told me not to respond any k3 forms.Now i received a letter stating that they sent k3 to chennai , india consulate.i would like to pursue cr1 and i am well prepared for that

i am still waiting for IIN and 864 to be generated.

they put me in dilemma.....donot know what to do now.

here are my concerns ?

1.What are my best options to pursue on k3 path ?Do i need to call consulate to cancel k3 path?

2.What does my wife have to do if she receives packets from consulate?do we need to proceed for that? is there any good guide for k3 path?what forms to fill out or prepare for that...??

3.Do they give interview date for k3 ?? if so when immediately after they receive file from NVC?

4.I did see some ppl they got interview date for k3 then converted to Cr 1 interview?

any input or advice is well apppreciated.

08/23/08 I-864 bill status "PAID" online(saturday) but AVR message says " case number assigned ....blah

08/23/08 Printed out I-864 package online and Barcode sheet

08/25/08 I-864 package sent overnight

08/25/08 DS3032 Hardcopy sent by express mail (Hopefully they accept it ..But AVR says AOS fee received/paid on 08/23/08)

08/26/08 I-864 package received per USPS

08/28/08 I-864 package entered into NVC system

08/27/08 NVC accepted DS-3032 (But AVR does not say that)

08/28/08 IV bill generated ( still AVR does NOT say that) but online INVOICE says "NOT PAID"

08/28/08 IV bill paid online "IN PROCESS" status

08/29/08 IV bill "PAID" status (AVR says , they received DS3032)

08/29/08 DS-230 generated

09/02/08 DS-230 and required documents mailed

09/03/08 DS-230 form arrives at NVC per usps

09/04/08 DS-230 information entered into NVC system

09/15/08 CASE COMPLETE(32 days no RFE)

10/15/08 sent to consulate

11/10/08 Medical PASSED

11/18/08 Interview....VISA GRANTED ...

11/29/08 ..POE at Houston

12/15/08 ..Welcome letter

12/16/08 ..SSN received

12/29/08 Green card received

For K3 path:

1) the consulate will send you packet 3 contains a checklist, instruction and forms.

2) You return the checklist and forms.

3) Consulate send you packet 4 contains K3 interview appointment letter, medical forms and instruction.

No need to cancel anything, if you complete the NVC processing of I-130 before the K3 interview, it will turn into a CR1/IR1 interview. Worst case scenario: you need to go back to the consulate for another CR1/IR1 interview.

08/28 Submitted civil docs & paid $400 IV fee. Visa Interview & approved !!!

08/29 Visa in hand

09/30 POE IR1 visa interview took 166 days from the I-130 filing date (expedited).

10/04 Applied for SSN in married name.

11/11 Welcome notice received (dated 11/04)

11/15 Received Green card.

11/21 2nd Welcome notice received (dated 11/13)

11/24 Received SS card in maiden name.

i dont know too much about K3 but looking at ur case, i can only advise u is to delay the processing of K-3. at the same time go full pace with the NVC process. contact Steve Y Jessica (another vj member) who had the same situation as u where both of his applications were approved. he may be able to provide some good advise to u. and yeah...just as thai mom advised, please dont cancel anything.

You should call the consulate once DHL tracking shows your package has reached the consulate. You may be able to pick up the packet if you live near the consulate.

Applying for a K3 or K4 Visa

The embassy or consulate where you, the spouse of an American citizen, will apply for a K-3 visa must be in the country where your marriage took place. Here are the procedures to apply. The embassy or consulate will let you know any additional things to do, such as where you need to go for the required medical examination. The following is required:

* A passport

* Two completed DS-156, Nonimmigrant Visa Application forms

* Two nonimmigrant visa photos (two inches/50 X 50 mm square, showing full face, against a light background)

* Police Certificate

* Court and prison records

* Birth certificates

* Registered marriage certificate and other proof of relationship. Note that a deed of marriage is not sufficient proof.

* Proof of relationship with any child (K-4) visa applicant.

* Proof of the legal termination of any previous marriage: death certificate of spouse, or decree of divorce or annulment

* A medical examination.

* Evidence of Support: You must show evidence that you will not become a public charge in the U.S. A completed I-134 Affidavit of Support form along with supporting documents from your sponsor is helpful in proving that your sponsor has sufficient financial resources.

* A demand draft for the Visa Application fee.

The consular officer may ask for additional information. It is a good idea to bring marriage photographs and other proof that the marriage is genuine.

Documents in foreign languages should be translated into English. Take clear, legible photocopies of civil documents, such as birth and marriage certificates, to the visa interview. Original documents can then be returned to you.
