Hey Guys,

My friend asked this question for her situation. SO VJ is the only plave I can get answer for her.She just started working this year and will file tax for this year after dec 31 2008.After that she will apply for her Fiance.Her Income is above the 125% poverty level requirement,She has stable job.

She does not have prior years tax returns.Do she still need a Co Sponser as she is required to have three years of tax returns.If somebody has same situations and got approved ? or somebody know about it?

We just had our interview in Kiev Aug. 7 They told me they consider FIRST the persons CURRENT income. If the current employment exceeds the standards and is verified, it is all that is necessary. I do not know if other consulates have different rules.

My son filed a K-3 for his wife with no 2007 tax return and was approved. His income for 2008 sounds similar to your friend's. The visa information line at the State Dept. told him to write a notarized letter explaining his situation. He included everything possible in support of his I-134 to prove that his wife would not become a public charge. He had been a student attending school on his VA education benefits. It can be done. I think the notarized letter was the key, but we will never know for sure.

By the time her Fiance go for Interview she will have tax return for one year and letter from current employer stating her income.Will that be sufficient or It is hard rule that she need to have tax return for three years not one year
