I130 was approved but not K3

Do you think there is a chance that we could still see approval on the K3? I130 was approved 8/11 after 58 days. It is not at NVC yet and I just wonder why the one was approved and not the other. I see many here that get both approved at the same time.

I know every case is different, I am just hoping to see K3 also in case the I130 gets slowed down at NVC.

Do K3 approvals come after sometimes?

Consider yourself lucky... it might just be that CSC is so damn fast that they dont even get the time to pair the petitions together and thats why your petitions will get approved at different times.

:DI think anything is possible in this ocean of unknowns! I am currently waiting for the approval for the I-129 forms I sent in last week. I have looked at my own I-1797C and don't see anywhere that it is an approval notice, just a reciept?! I don't understand all of the lingo either! So Good LUCK! MABRUUK! Unless there's some major reason that you need your spouse here right away, I would go with the I-130 for the CR-1 visa. You wont need an Employment Authorization. No AOS (Adjustment of Status) If you've been married for more than 2 years you will get a 10 year green card, if not a 2 year green card. Saves a pretty good bit of money as well as hassle. It just takes a little longer. If you follow lotofpatience shortcuts, it seems like you will be able to get out of NVC in about 6 weeks. Personally I've decided to go that route myself, and forget about the K-3.

Note:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)

Also with the online payment system it is possible to have the CR1 done before K3, prime example, A fellow Vjer had their 129f for k3 approved May 29th for their Brazilian spouse, my I 130 was approved on June 2nd, now the other members 129F made to NVC before my I 130 did and was sent to the consulate way before my I 130 was, I cleared NVC in 33 days and my wifes interview was scheduled before the K3 filers by 4 days. My wifes interview was the 15th of August and their interview was on the 19th of August. With the new online NVC system there really is not that much difference in the times and can even be faster than a K3 who was approved and sent to NVC before a CR1. I think that it is because NVC sets the CR1 interview dates and the embassy works around what the NVC has scheduled. And since the only real time that was saved with the K3 was the time at NVC the new online payment system can almost make that a non issue.

Well let me change that because i went and looked at her timeline, she was approved on May 15th and her 129F left NVC on June 2nd, the same day that my wifes I130 was approved at USCIS. So even though the consulate had her 129F for a month before my wifes case cleared NVC my wife still had her interview 4 days before the K3 filers. Same consulate in Rio de Janeiro and a CR1 filer who was 17 days behind NOA2 from USCIS and a month behind on the consulate level still had their interview 4 days before the K3 filer, nothing wrong with going the CR1 route at all.

why wud u even think of getting ur K3 approved when ur I-130 is approved. i know it would add an extra 2-3 months to ur case but u wud b 100 times better with the CR-1 route. ull save around $1300 (i dont know if thats not a lot of money for u, but for a lot of us here it is)...ur spouse will have their greeen card the day they enter the country...adjustment of status in case of K3 means around 1 year wait to get the green card....not to mention a ton of extra paperwork that ull have to file...more papers, more trouble...be thankful that u r lucky enough to get I-130 approved..

if you got your I-130 approval, it may simply means your application for K3 has been set aside. this has happened for recent filers, including me. we too filed for K3 but since we got the approval of our I-130, the K3 application disappeared like a bubble in the wind.

you should be more delighted you have that on hand so you wont have to worry about AOS in the US, not to mention the huge amount you will save if you go through the CR1/IR1 rather than K3 (1,010 USD for AOS). plus all other benefits like, you wont have to apply for SSN when you get to the states since in CR1/IR1, an IV application (DS-230) will be filled out in advance, you can sit and wait for SSN to arrive with GC a month after you arrive, no more paper works to worry once you go to the US. dont think of the waiting time, sooner or later you both will be together forever, a couple of months waiting for CR1/IR1 is just a spect..

Check this out.... they arent being consistent with this but it may explain why the 130 was approved and not the 129f.

Another representative stated that I-129Fs are not closed and USCIS is continuing to process the I-129F. Is USCIS administratively closing the I-129F application if the I-130 has been approved? Can USCIS provide clarification on this process?

USCIS Response on April 30, 2008: USCIS has been administratively closing the I-129F upon approval of the I-130. USCIS, however, is currently reviewing the I-129F/K-3 process. "

Timeline: 13 month long journey from filing to visa in hand

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.

K3's are getting out of NVC in a week and interviews are being set. I'd like to get in that group, the one with the interview dates in November.

I think we have all learned or will learn that USCIS is one screwed up agency....I don't think they know what they are doing at all. We just got our K3 approval...months after our I-130 approval. This K3 approval came after our I-130 at NVC paperwork was already complete. To be honest, with all the paperwork and fees we had to pay to NVC for the I-130 we sort of forgot about the K3 because we were already that far along....we hadn't heard a word about the k3 and to be honest, I never even went back to USCIS's website to check the status of the K3..given we had the I-130 approval first...

So...we are all done at NVC...just waiting for case to be scheduled...and along comes our K3 approval from USCIS. Yes, the K3 interview is scheduled at the Amman embassy for Nov 3...and no, we still don't have an I-130 interview yet in Amman...we didn't get scheduled for September...so now we are waiting for the 2nd week of September to see if we might be lucky enough to get in for October. We already have our Nov 3 K3 interview set up...which, if we don't get our I-130 scheduled in October, I will request the K3 interview be turned into the interview for the regular immigrant visa....since that is the best way to go and we already did all of our papers, paid fees, etc. and I am sure they will grant that request.

Apparently the NVC is only being supplied with a limited number of appointments (and apparently not enough) for regular immigrant visa appointments. I don't know how NVC prioritizes who gets the appointments but the whole process is not good. I had a great experience with NVC throughout the entire process but when it gets to the point of scheduling, they have their hands tied and only have to work with what the embassy gives them. It would be much better if the embassy did all of the scheduling for all cases, not just the K3's.
