Hi guys.

Okay I have my Fiance Visa stamped inside my passport and I'm ready to fly out. I'm really looking for some help about the next part of the process. As I understand it you can get an EAD at the airport from immigration, but I would have to have this renewed in 90 days. As we are not getting married until November (almost two months after I arrive) I'm wondering if that will leave us enough time to renew the EAD when we undergo the AOS process. I guess not but if we leave the EAD until later that might mean I cannot get a job until the next year, which will seriously leave our funds stretched. Any advice on this? Is there any other way to ensure continuation of the work permit even if the AOS process is still pending?

Hi u'r a K1 visa, just in case that you will get a work authorization card during your port of entry, that valid for only 90 days. You cannot renew your EAD with out AOS reciept when your EAD will be expired after 90 days. but if you really want to renew your EAD with out AOS recipt its a more cost. so I advice you as soon as you get married, apply a AOS, EAD as soon as you can if you want to work while the USCIS processing your AOS. hope this help.

You won't get an EAD at the POE, but you might get a work authorization stamp, which will be good for the 90 days that the I-94 is good for. It isn't renewable.

You'll need to apply for EAD after you're married, and there will probably be a gap between the I-94 expiration and EAD approval. Since you're getting married 2 months after arrival, there will almost definitely be a gap. Recent timelines show EADs being approved on average about 75 days after the AOS package is sent in. That isn't something you can plan on, though. Some are faster, while some take much longer.

it's either to marry right when you move and ask for aos/ead/ap right away

or to live with the fact that there will be a certain gap with the financial consequences.

You cannot renew the EAD without the AOS being applied for period. The temp stamp, as you say, is good for 90 days only. There is no renewal of any kind of work authorisation until AOS is applied for. Your post is confusing to someone who might be new and not totally understanding this process.

Even when AoS is applied for it's not a renewal. Category (a)(6) EAD cannot be renewed. When you submit AoS it's a new application for category [c][9], not a renewal.

You are looking at 2, 2 1/2 months after marriage/mailing the AOS packet to receive an EAD. Getting married within a short period of time, even if it is a civil ceremony will at least allow time to process/receive a 1-year EAD card before your temporary stamp expires. That might be a second option, other than accepting an unemployment gap.
