Current Status: This case has been received from the State Department with a request we review it.

On June 29, 2009, a USCIS office received this case from the State Department with a request that we review it. We will notify you when we complete our review, or if we need something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address. You can also receive automatic e-mail updates as we process your case.

Im sure it is some little stupid thing other wise they Embassy would have denied the case or at least told me the reason LOL Im good at waiting When our case was under AP I at least knew I was looking at a year wait now I understand it can be about 2 more years no one seems to know much about cases that are returned at any rate I dont even thinks about it that much now.

You have sure been thru a lot- AP for almost a year to then have your case returned back to the U.S.? And they don't even give you a reason? Man, this whole process can be mindboggling......

1/21/2010 - Visa delivered by courier- BUT, she opened sealed envelope that was for U.S. Immigration at POE.

Now embassy in Bogota wants us to do the medicals all over again.... nightmare continues.....

2/22/2010 - She went back to Bogota to get labs and medical re-done. Then back to embassy where they finally

re-issued the visa. Is valid until July 13th

7/3/2010 - She made it to the U.S. finally!!! I filed on November 11th 2008 and went thru 8 1/2 months of AP

Oh I am so sorry that you are going through this horrible mess. Have you contacted your senator/congressman to make an inquiry about what is going on with your file over there? Even if it doesn't help you find out what the problem is, the fact that senators/congressman are inquiring is enough to alert them at least a bit.

We found out today that the US Embassy in London is requesting a new DS-157 from my fiance. What could be the reason? Did they lose the first one or do they want updated information? And what does this mean? That they are almost done with AP?!? I spoke to Jessica (really nice DOS rep) and she told me that they are asking for a DS-157 from my fiance and she hopes his AP is done soon, of course no one knows when it will be done, but anyone heard of this before? Embassy requesting a new DS-157 after 4 months and 6 days of AP?!?

Please add us to the AP process. We started Ap September 9, 2009. this is the email we received back from the Bogota embassy.

Dear Mr. Whitted:

We are very, very sorry, but in your wife’s case, there is an administrative process that is required by law to be completed before we can approve your wife’s visa. Unfortunately, we did not notice that this process was necessary until after your wife had departed the Embassy.

We apologize for the confusion and the system malfunction that resulted in your wife having to come to the Embassy twice, and we also apologize for the delay in issuing your wife’s visa. We are doing everything possible to expedite her case, and we are sensitive to the fact that she is pregnant. We are hopeful that this process will be resolved soon.

I had my interview on March,26,2009.The CO says everything looks good but she needs to do some AR and i asked her how long it will take? she says 2 weeks. i have been under administrative process for more than 5 months.

I got an email from the embassy to send my passport on July,30,2009.

I sent my passport on Aug ,2,2009 .

Every time i send an email to ask about my case status i got the same answer '' the case is pending consular officer review''

On Thursday Sept 17,2009 the Embassy called me and they asked me for a second interview on Sept ,27 ,2009 at 1 PM.

I know it doesn't sound promising sad

I want to know if anyone here had the same situation ?!!!

I thought that they asked me about everything at the interview .so what will they ask me about this time ?!!!!

I wonder why they told me to send my passport and now they need me for a second interview?!!!

Dose that make any sense at all ?!!!!!!!!!!

Do you know the times and days of the week they hand out visas?? I ask because our 2nd interview is on a Thursday at 3pm (they hand out visas on Tuesdays and Thursdays at 3pm) I talked with Jessica at DOS and at first she thought it was VERY strange to have an interview in the afternoon she said she'd NEVER seen an interview in the afternoon. Then I told her the visa days and she said, "OH....... well then don't worry about a thing, everything is in order. Just be sure your husband brings his passport to get into the embassy." Now she didn't outright tell me that we are getting the visa but I could definitely tell by her tone and they way she said it that the interview is just to see me, maybe ask a couple of questions and then give us the visa.

Hello Whidbey,

I am a little confused regarding your second interview. It was my understanding that your disclosure to the Embassy that you were visiting initiated the second interview. Or did they schedule a second interview, which you planned to visit because?

When I read your story assuming that your disclosure of a visit initiated the 2nd interview, I did not think this would end your AP, but only assist in their investigation. Now mind you this is all based on my assumptions to a situation that is unique (wife being available to interview for 2nd).

If they had other things they want to verify, i do not think your will be out of AP. Many people are put in AP for document verification, records verification, home visits. Now mind you AP is still a mysteria and can mean so many things.

Update:

Yesterday, DOS:

Case has been approved but transferred to NIV unit from the IV unit for quicker processing...approved but waiting on administrative processing to be complete. The transfer from IV unit to NIV unit caused the request for the new DS-157. He sent his new DS-157 via email attachment (weird request by the embassy via email asking to email the DS-157 as an attachment...stupid of them to say because the DS-157 is not in savable format, however we managed to obtain a savable version from a fellow VJ member) to London on Friday Sept 18, 09, but according to DOS, it hasn't been put in the system yet.

Today, we get a copy of the letter my congressman's staff worker wrote to DOS (and she has helped us all along, but this time she messed up!). I called to let her know she wrote the inquiry incorrectly, and she told me that she already has the answer for it and that it doesn't matter that she worded the inquiry incorrectly(it DOES matter!) the reply is "pending administrative processing, there is no time limit, and the I-129F does not expire while K-1 is in AP"...we explicitly explained the situation to the staff worker at the congressman's office, that we need information regarding what will happen if end of Nov 09 rolls around and my fiance's K-1 visa is not issued but his UK student visa expires and he has to leave the UK...the staff worker worded her inquiry to DOS as, "....worried that her husband's (I can't beleive she wrote husband when he is my FIANCE) visa will expire while his visa is in in administrative processing..." This statement makes NO SENSE to me, so how would DOS know how to respond properly? Especially since I have had detailed conversations with this staff worker, I don't know how she messed up this inquiry. So anyway, the staff worker said she would call DOS and get back to me, but she said, "I am pretty sure he can stay out of status in the UK while his K-1 is processing. But I will call DOS and get back to you on that" WTH???? NO HE CAN'T! And I don't know if she will get back to me because she forgot about the first phone call inquiry she said she was going to make for me.

I still did not hear back from the embassy when I emailed them asking what is going to happen to the K-1 visa processing if his UK student visa expires and he has to leave the UK. And today, DOS reps tell me it is still in administrative processing.

So I don't know what to believe except pray and hope that it really has been approved and that it will be issued soon!

Update:

I have a couple of questions for you: I have heard that if a consulate (embassy) wants to not approve a visa after the get completed with their AP, they return it back to the U.S. Is that kind of their way of "rejecting" the visa? I have also heard that they will inform you that they plan on doing that, and one should try to keep it there at the emabassy, at all costs. Any idea how you go about "keeping it there" if that happens? I know yours got returned. Wondering if you were told it was heading back to U.S. before it happened?

12/28/2009 - Embassy finally called my gal for another "interview"

1/14/2010 - VISA APPROVED at the second interview- took about 8 1/2 months of AP

1/21/2010 - Visa delivered by courier- BUT, she opened sealed envelope that was for U.S. Immigration at POE.

Now embassy in Bogota wants us to do the medicals all over again.... nightmare continues.....

2/22/2010 - She went back to Bogota to get labs and medical re-done. Then back to embassy where they finally

re-issued the visa. Is valid until July 13th

7/3/2010 - She made it to the U.S. finally!!! I filed on November 11th 2008 and went thru 8 1/2 months of AP

AOS

12/16/2010 - Sent in packet by Fed Ex to Chicago

1/7/2011 - Notified by email from USCIS packet was received

1/25/2011 - Notified by email we are receiving an RFE

2/4/2011 - Sent translated birth cert in (RFE)

2/9/2011 - Biometrics done

3/1/2011 - EAD/AP card received
