We have found out today that my fiance is on AP. He was interviewed May 12, 09 in London for his K-1, he is a Pakistani citizen but resides in the UK (student). He was issued a 221(G) ONLY for his passport, which he did not have at the time of his interview. He was told once he sends in the passport, he will get the visa. He sent in the passport on June 12, 2009, and we heard nothing from the embassy or DOS regarding the status of his K-1 visa issuance until today.

I (I am the USC in USA) got a call from a CO in the US Embassy in London. She was asking me all sorts of questions, it was a phone investigation. She asked me all the questions that my fiance was asked at the time of his interview in London.

My question is, how much longer do we have to wait now? I am sure their doubts have been eliminated if they were trying to verify our relationship by this phone investigation.

Does a phone investigation usually mean the visa is printed soon after? Granted that the CO is satisfied by the phone investigation?

Can anyone else with a phone investigation share their experience?

This whole process is b*******.... I have been put on AP for more than a yr and marriewd for 2 1/2 yrs.....then finally they say my case is in the "final " stages...

Then we get a letter in the mail saying that our visa application is cancelled because we did not apply for an imigration visa ?!?! what the **** all i have been doing waiting for my immigration visa !

allday i have been contacting the embassy and my senator has been involved in all the talks... how can they deny us on the basis of 203 (e) saying that we did not apply for a imigration visa when that is what im waiting for !

anyone has any sugggestions plz help i am going on monday and i will raise noise at the embassy i want everyone to rememebr my case and face!

Wow, that whole sentence in their letter contradicts one another

I hope you made a copy of the I-130 application that you had sent... maybe you should make a photocopy of your receipt letter, approval letter, and NVC letter or scan them and mail it to the embassy to show you did apply for an I-130 and it has successfully went through the USCIS and NVC... what makes you feel hopeless is the fact that the embassy is at such a distance to resolve this case, but there has to be a way somehow. Consult with a few lawyers here, and ask your husband to consult with a few lawyers in India to figure out how the resolve this issue.

thanx to both of ur responses.... i have all the letters they sent me saying that my case does not need any information and that its undergoing administative processing....

hopefully there is a mistake in my case... they asked for the passport a few times and so far they have kept my passpot for 2 weeks now...

i am in india and have been here since march so i will go to the embassy and with proof to see what they are talking about also i will request to speak with a supervisor there ... thanx for ur support its just so emotionally draining....

It's official after going through the I-601 process and being approved they have decided that an AP would be good for us.

First they ask for form DS-221 to be filled yet it is not available to the general public, I was thanks to a memeber here was able to get it and fill it and will be send it shortly along with the requested noterized letter from the petitioner stating she is aware of the ineligibility for conviction of a crime involviinig moral turpitude and she still wishes to pursue the marriage.

We were give the following:

This office regrets to inform you that it is unable to issue a visa to you because you have been found ineligible to receive a visa under the following section(s) of the Immigration and Nationality Act. The information contained in the paragraph marked with "X" pertain to your application. Please disregard the unmarked paragraphs.

(X) Section 221(g) which prohibits the issuance of a visa to anyone whose application does not comply with the provisions of the Immigrtion and Nationality Act. or regulations issues pursuant thereto.The following remarks apply to your case:*

Petitioner aware of ineligibily and willing to marry; and FormDS-221 with item numbers 1 through 19, 21, 22 and 24 completed on each copy.

1/21/2010 - Visa delivered by courier- BUT, she opened sealed envelope that was for U.S. Immigration at POE.

Now embassy in Bogota wants us to do the medicals all over again.... nightmare continues.....

2/22/2010 - She went back to Bogota to get labs and medical re-done. Then back to embassy where they finally

re-issued the visa. Is valid until July 13th

7/3/2010 - She made it to the U.S. finally!!! I filed on November 11th 2008 and went thru 8 1/2 months of AP

Sounds like Gordon Lightfoot to me- A Canadian dude, I think! I'll have to do some reading Ron- I'm not sure what an I-601 really is.... but, looking at your timeline, you have been at it for a long time. :clock:

Well Joe, be glad you don't know what a I-601 is, it's like a minimum 12 month guarenteed AP. I guess for me it was a training session leading to the real thing, this AP.

I have been reading a bit and see that people get thier APs right after thier interview all I got was a I-601 and I did get an AP but that was dropped quickly after I wrote to the Director, one thing you don't do is tell a 25 year sober alcoholic that you smell booze on his breath and put it in his file. The I-601 was for a 33 years old conviction.

P.S. my interview was in August 2007
