LOL he was coming 9-11 but I didnt think that was a good time to fly so we are looking at 9/16 so if he gets here Thursday he can rest Friday and then we have the whole weekend. I think his POE will be easy my son is interpreter in customs so he will be with him.

well it's official the embassy returned our petition to USCIS. I am sitting at my desk at work bawling. i guess nothing is going to get done today. I am so disgusted with this system.

So the reason cited is 221(g) and "based on indications that petition {number} contains inaccurate information"

with (of course) no additional information. His visa was stamped "Cancelled without prejudice", that's the "good" news. ha ha.

so i guess the question is... what do we do now?? Is it true that USCIS never reaffirms I-129Fs, they just send notice that it's expired?

And how do we find out what they considered "inaccurate information"??? there is that issue with the address that we forgot to list on his last 5 years history (he was registered there and it was technically a permanent address but he never lived there or even actually saw the place), but how can we be sure that's it? or that's the only thing?

Can we do FOIA? how long does it take?

If we get married and do the I-130, we would be filling in basically the exact same information except that one little address thing. Would they have really done this to us because of that??? His mom explained about the address when they called her....

i hate hate hate hate hate this. anyway, this is my coping mechanism i am alternating between crying/exploding with anger while obsessively researching. must. figure. out. what. to. do!!!

I don't know the exact info about your case.

I heard that couple of peoples I129 was declined or cancelled, they went with marriage over there and all went ok.

I know a person from India had 129 visa declined at embassy, now she went to get married to her husband( now) and filed 130. I know she will be fine now.

I am so sorry to hear this news but dont give up its just going to take alittle time and if you check out the tracker another person from Russia is going through the same thing. I dont understand why it takes so long to decide to send a case back mine took 10 months and the reason they said the wedding pictures look posed LOL dont most people pose for a wedding picture. Anyway you will hear from USCIS so wait and see exactly what they requesting. Good luck

Just curious, though - I know in your case you did CR-1, right? Did you ever hear of any case where USCIS actually sent a request for info for the K-1 petition? Any example I found the couple just ends up waiting and waiting and then finally USCIS notifies them that their petition is expired and therefore there will be no further action. Without giving any info on the reason why revocation was recommended. So, if that's all we have to hope for, we don't really want to wait for it. Or is there actually a chance they will tell us and allow us to show proof and get our original I-129F reaffirmed?

is there anybody has experiences with field investigate by embassy?

on last week, the do the field investigate on my fiancee home town.

Did anybody know how long it will still take after field investigation?

i have been reading so many post and congrad. to everyone who has been over with AP. Espcially, Whatisnextz.. i am happy for you :)

Thanks so much You were my inspiration! It seems like yesterday but I know it has been a couple of years. I hope things are going well with you and your husband. What a journey we both have had. I hope my husband arrives here safely. He is so nervous. But somehow I feel like a ton has been lifted off my heart. Life has a ray of sunshine now......I was soooooo tired of living date to date my heart goes out for anyone facing the kind of delays we went through.

hey friend :) life has been great since he arrived. We bought a house and a car. He did have to go home for an emergency but he is back. I wish you both all the happiness. We barely even think of the struggle. But we know if we can make it thru immigration pains then nothing can stand in our way :)

They did the same to us in early August... Its part of the Fraud investigation process... dont be surprised if they call to do a phone interview... look at it as a good sign, because someone is actually working on the case in one way or another... it could take a few weeks more or months depending on the consular officer... our consulate is known to clear cases after the new fiscal starts.. Oct... so we are looking forward to good news in the coming weeks...
