Bleh.. Called DoS and they have no record of the visa being approved or issued.. and nothing showing up on the tracking envelope. Though the consulate DID finally update my address. I reeeeeally hope this isn't a false alarm. :( Why would the consulate tell the senator before they told DoS?

Whatznext.. Did your husband give them an updated I-864 at the interview? Kevin says if they had the old one it wouldn't have been good anymore and that's why they asked for another.. hope it goes through for you after they get it.

Well I'm not whatznext but my fiance got this email when he got home, from his senator:

"Dear Mr. XXXXXX,

Thank you for contacting my office with your matter. I have contacted the United States Embassy in Montreal on your behalf, to which I received the response, "I'm following up with great news that the admin processing has been completed on this case and Ms. XXXXXX is being issued her K-1 visa." I hope this information will be of help to you.

If I can be of further assistance to you, please do not hesitate to contact my office again."

Soooo stoked.. after 14 weeks.. I can't wait til I have the visa in hand.. so sure something else is gonna go wrong or there was some mistake by the senator :wacko: would be great to have it on Friday though since we are already heading towards my fiance's on sunday for a family thing (in canada though).

Seems like a good week, hope it is one for whatznext too!

To all the good people on VJ Im very sad to say I dont have good news. I feel like Im sinking down into a dark pool of water but just to let you know Im not exactly drowning yet. My husband went to the Embassy with all the requested papers and photos. He was interviewed again like it was the first time the interviewer didnt realize this was a reaffirmed case. At any rate she asked for a signed I-864 in blue ink by me. Now I have to send him this piece of paper by FEDex at the cost of $157.00 and he has to ride a train for 10 hours to put this paper in a drop box at the Embassy. The sad thing is we all know they have the signed I-864. So now I am wondering as always Whatznext. However after I got this piece of info I called DOS to see what they said. She said he had his interview so what exactly do you want to know. I explained the I-864 she sad she understood my point that they have to have it but that is the info the Embassy is requesting at this time. It disgusting to think we have such incompetent people working at the Embassy. Anyway bottom line is no visa yet

Kevbev09 congratulations LOL I guess some Embassys are better than others Keep us posted on the date the visa is issued.

Amit-N-Melody I might have missed it but do you have a arrival date for your husband yet???????

They are probably doing internal work and he will receive a letter soon that the visa is being issued at least the AP is over if you call DOS again you will probably get a different response Good Luck

hello, all today i checked uscis status its said that :-

Post Decision Activity

On August 16, 2010, a USCIS office received this case from the State Department with a request that we review it. We will notify you when we complete our review, or if we need something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations.

The only info I can give you is it will take 4-10 months Unless someone has a better time frame the shortest I have seen is 4 months and mine took 10 If you are interested in a chart of received cases I can give you a link so you can see the work flow my case was received at the highest volume month so LOL I waited and waited but in general the volume is decreasing each month so you might not have to wait very long. Thanks and I feel your pain I hope you get some answers soon. The copy of the I-864 signed in blue ink is on the way to my husband. Now I am back to the waiting game but he is really upbeat he is thinking very positive so maybe he got good vibes from them. Time will tell.

I hope by "internal work" you mean printing the visa? lol.. The consulate told me specifically at the interview that they will NOT inform us when the visa is issued so can't hope for a letter, all we can do is wait to get it in the mail or get a positive response from DoS.

yes I do thats a bummer but hopefully its on the way My husband had a interview date and the information never showed up at DOS but I called yesterday about the signed I-864 and they already had that info in the system so go figure

We just joined the list of those on AP yesterday, I have a questions.

I see people calling DOS when they are on AP, I thought they should be calling the embassy in thier country. Which one is better to call? and how long should we wait before calling them?

Everything was fine with ours, but I think they need to validate her divorce certificate.

it varies by embassy - if your embassy will actually give information, calling (or e-mailing) them will provide more up-to-date results. But DOS actually picks up the phone :-) Try both!

I believe the general guidance is to wait 60-90 days before starting to bug the embassy about AR (and hopefully your case is resolved before then!). Others may jump in with other thoughts?

Unrelated note - A random thought for everyone in AP: It could always be worse!

AP sucks - but at least we're not spending these long months trapped in a mine underground! Provides a little perspective... 4 months of that!!! I'm sure you've all already seen the news, but here's a link just in case: http://www.msnbc.msn.com/id/38830593/ns/world_news-americas/

Anyway, made me think :-) And feel a little better about our situation in comparison...

2010/02/05 - embassy calls and asked to return visa for a "correction"

2010/02/09 - fiance returns passport with visa to embassy

2010/09/07 - fiance receives passport back with canceled visa and letter; our petition has been returned to USCIS

Does that mean, after your interview the Consulant office communicates immediately to DOS the decision or status of your interview? Can they(DOS) tell you why you were put on AP?

yES, I plan on start calling the embassy after a week or two, I hear in my country you have to call and get things moving.

At what stage can one get the congressman or senator help?

The consulate and DoS are on the same computer system since the consulate is part of the state department. They cant tell you why.. and often only say AP and thats it. some will let you know when the last time something was done or where the investigation is being done...
