We got a refusal letter section 212 a3b whatever that means. i wanna cry so bad. im so tired of all this. I guess im goin g to just get married and pray we are approved . How to you even find out why? hes never benn in trouble. and we lived together for 9 months.

Thanks everyone for the wonderful welcome. Not that I care to be in AP but to meet such a wonderful group of kind, helpful people certainly helps pass the time, enjoy some humor and encourage others.

I am not sure if I will be entitled to a grandfathered Visa this November <slight giggle> since it will be 3 years since we began....,OR, I perhaps could be a grandfather <excessive giggle> prior to receiving the Visa. My fate lies in the hands of others....darnit.....

Hello Everyone,

My Wife had her Interview on May 7th, 2010 in Islamabad, Pakistan

She was put on "AP" and for the past 2months or so I have been calling DOS (Dept. of State) and I called and said I would like to get the status of my Wife's case. I gave her the case # and 1 minute later she comes back on the online and asks for myself and my wife's name and the she says "Congruatlions the Visa was issed today" ....I AM SOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOO HAPPYYYYYYYYYYYYYYYYYYYYYY

For whose you are in "AP", my prayers are with you guys and I pray to ALLAH that your "AP" is over and you unite with your loved ones...we are one waiting for American Express to call my wife to pick up the visa!!!!!!!!!!!!!!

212 a, 3 B is a serious denial

(B) Terrorist activities-

(i) In general.-Any alien who-

(I) has engaged in a terrorist activity,

(II) a consular officer or the Attorney General knows, or has reasonable ground to believe, is engaged in or is likely to engage after entry in any terrorist activity (as defined in clause (iii)),

(III) has, under circumstances indicating an intention to cause death or serious bodily harm, incited terrorist activity,

(IV) is a representative (as defined in clause (iv)) of a foreign terrorist organization, as designated by the Secretary under section 219,

(V) is a member of a foreign terrorist organization, as designated by the Secretary under section 219, which the alien knows or should have known is a terrorist organization,

is inadmissible. An alien who is an officer, official, representative, or spokesman of the Palestine Liberation Organization is considered, for purposes of this Act, to be engaged in a terrorist activity.

(ii) Terrorist activity defined.-As used in this Act, the term "terrorist activity" means any activity which is unlawful under the laws of the place where it is committed (or which, if committed in the United States, would be unlawful under the laws of the United States or any State) and which involves any of the following:

(I) The highjacking or sabotage of any conveyance (including an aircraft, vessel, or vehicle).

(II) The seizing or detaining, and threatening to kill, injure, or continue to detain, another individual in order to compel a third person (including a governmental organization) to do or abstain from doing any act as an explicit or implicit condition for the release of the individual seized or detained.

(III) A violent attack upon an internationally protected person (as defined in section 1116(b)(4) of title 18, United States Code) or upon the liberty of such a person.

(IV) An assassination.

(V) The use of any-

(a) biological agent, chemical agent, or nuclear weapon or device, or

(b) explosive or firearm (other than for mere personal monetary gain), with intent to endanger, directly or indirectly, the safety of one or more individuals or to cause substantial damage to property.

(VI) A threat, attempt, or conspiracy to do any of the foregoing.

(iii) Engage in terrorist activity defined.-As used in this Act, the term "engage in terrorist activity" means to commit, in an individual capacity or as a member of an organization, an act of terrorist activity or an act which the actor knows, or reasonably should know, affords material support to any individual, organization, or government in conducting a terrorist activity at any time, including any of the following acts:

(I) The preparation or planning of a terrorist activity.

(II) The gathering of information on potential targets for terrorist activity.

(III) The providing of any type of material support, including a safe house, transportation, communications, funds, false documentation or
identification, weapons, explosives, or training, to any individual the actor knows or has reason to believe has committed or plans to commit a terrorist activity.

(IV) The soliciting of funds or other things of value for terrorist activity or for any terrorist organization.

(V) The solicitation of any individual for membership in a terrorist organization, terrorist government, or to engage in a terrorist activity.

(iv) Representative defined.-As used in this paragraph, the term 'representative' includes an officer, official, or spokesman of an organization, and any person who directs, counsels, commands, or induces an organization or its members to engage in terrorist activity.

When they did thier namechecks or background checks he came up in a big way IMO... whether they are right or wrong in thier decision of terrorist ties it will take a great deal of evidence/legal skills to get through this hurdle.. it will have to be addressed to ever get him a visa... when they send the case back to USCIS this must be addressed.... I am so sorry to see that this is what they came up with.. best of luck... and I am hoping you made a typo in your post and it was not 212 a3b

No i didnt post wrong. It is that. But no he has never even had a speeding ticket. He is christain and has never been in trouble ever. But if you read our interview info 3 weeks before our interview the embassey had a call from someone threating them. Alen was the only Iraqi applying at the time. He was questioned by the police as was everyone else whom they could find whom had called the embassey that day. he let them take his cell and examine hes numbers and calls on it. He was never arrested they told he was free to go and they knew it wasnt him it didnt make since for him to threaten the embassey he was tryin to imigrate thru. They also gave him his phone back. omg it makes me so sad that people can just make up there mind someone is bad because of his origin or the color of his skin.im so sad

OMG this is the last time I joke with my hubby about being a terrorist. Oh this is some serious bad pookey. Do you think it could be his name was mixed up with someone else's or maybe with their alias? Or maybe they think he was an Iraqi bad dude fighting against the US (although I can't blame some of them, come into my house with guns drawn threatening me and see how I react).

I am so sorry, I wish I could advise you how to handle this matter but a simple getting married won't resolve it. It is going to take clearing the record on him.

Calm down there was a girl whose case was sent back but by the time it got to USCIS the codes she was given that upset her so were not even the reasons that were given to her from USCIS they addressed the issue his visa was issue and they are both here and married now. I wasnt given any reason can you imagine how your mind can wonder just stay strong and beleive in him it will be all right marrying him will not help until this issue is cleared up. Trust me it will be alright. It just comes down to time and if you are willing to wait it out.

No I didnt see the phone call info... DoS should be able to shed some light on the denial if the consulate actually input it into the system... As has been said it could be a typo on thier end.. I have also seen CO's cite things that were false in the denials... it very well could be that since they questioned him... he got labeled by the CO as guilty regardless of if he did or not... It will be interesting to see what they actually based the denial on...

dont let it beat you up... it just means it will take a while longer... :thumbs:

Did you call the Embassy to see what they have to say The Embassy didn't even have to give the reason and if they will not discuss it with you there is nothing to do except wait and see what USCIS says. I know how upset you are. But just try and calm down until you know what you are up against. I went 10 months with out even a small idea of why our case was sent back. You should have read some of the post and reason that were given to me from our very own VJ members and I must say they were not very supportive but we are here to be with you and hope to help you through this.

I know it just so sucks. I really use to believe in my government ha...What happened to not guilty til proven. guess that only counts if ur not trying to immigrate. Im just so sad. I miss him so much but we are not giving up. Please pray for Alen and i we are just both so heart broken.

Extra steps: Turns out in Juarez they do not tell you the final result of interview on the spot, you have to wait to receive a DHL package that contains the verdict and passport hopefully. Even though my husband was "approved" during interview (per consul answer) he was placed in Administrative Review on JUly 6 according to consulate operator.

Placed on AR post interview:07/06/2010

Picked up Blue slip AR (they kept his passport):7/09/2010

Visa issued: 09/15/2010

I was in AP for 2 months, 2 weeks and 2 days

Completed my journey in 10 months, 2 weeks and 2 days
