Timeline

Tracking AP can be so difficult since each consulate does things different... Our AP is very different from yours.. Just talked to DoS and they said to call back every day because should be finished soon...

We aren't in AP anymore...we are "Returned for Recommended Revoke of Approval"....in other words...embassy denied as they could. Is there a forum for these cases? Cuz i know there are a lot of them...cuz its no AP right? Its fighting off a denial?

Oh I'm so pleased to hear that there's been some movement in your case and that hopefully you'll be getting your approval very soon!!

I called DoS for the first time in a few weeks and the lady I spoke to I didn't recognise, but I appreciated how straightforward she was: "Your case is still being processed in Washington DC". That's all she said, none of the usual 'it's pending, I don't know where or why'. My husband's senator made an inquiry and surprise, surprise, got exactly the same generic response that we get when we email the embassy.

I talked to Sue today and she was so helpful and really sweet... said I didnt have any DC checks done, but that checks were done at the consulate and that it was a good sign that they called... from what she said, there are different screens that they can access and depending on who answers the phone, many wont dig for you... and depending on the consulate they input info in different areas... she dug deep looking to see if they input anything in the system.. with all of the calls last night, no notes in the system...

Hey, I'm just responding to this, the end of your previous post which you've not included - it doesn't sound like you're too sure :)

I'm just confused about the two 221(g)s....cuz everywhere it says 221(g) is for AP, but we received a Refusal Worksheet with 221(g) checked. I knows its not in Approved AP :)

There's no 'unapproved AP' - the regulation is used to not issue a visa until all checks etc are complete, OR to deny a visa - two separate things.

221g is not for AP,

It is a section of the US. Immigration and Nationality Act that prohibits the consulate from issueing a visa under two specific curcumstances. They can temporarily deny the case as is what happens with AP, or they can refuse the visa issuance and return the petition to USCIS.

In all cases the 221g is just the section that is referenced in the status/decision form provided to the applicant. its a vague umbrella that gives the CO a great deal of lattitude in deciding our fate...

Section 221 (g) of the Act prohibits the issuance of a visa to anyone who has failed to present the documents required in connection with the visa application or who has failed to submit sufficient credible evidence to support the claimed petitionable relationship.

Everything that encompasses the decision making process is supposed to be goverened by policy... thus the reason for the 221g as well as all of the other sections of the US. Immigration and Nationality Act that may be cited... another example section 212.......

Here is a place that includes others with cases more similar to yours... Not saying you are not welcome here.... those in this forum are in limbo at the consulate level waiting for a decision on the visa application.. many due to DHS checks others due to consulate investigations.. in all cases the file is at the consulate awaiting decision... Whatznext actually went through what you did in a way but is now back to the consulate.. hopefully not in AP again, but the she is the OP and maintainer of the spreadsheet.... it is common for VJ members to migrate from one forum to another as the case goes through the process...

Then technically they are still in AP until a decision is made. A few people have sent me personal messages and the cases returned to USCIS are being processed alot faster than mine was like 4 - 6 months

With CSC letting returned petitions expire.. not much processing left to do is there? With luck they will get a chance to rebut, but CSC has changed the way they do things and earned a class action lawsuit as a result...

When the case has been returned to NVC/USCIS as visa refusal, do they actually say Additional Processing when one calls DoS?
