Thanks for the great info guys. This just makes me more worried!!! My fiance has a very important job lined up and is supposed to start in Jan, 2010. And, I don't know when this AP will be over and if we go into another AP for AOS------ ughhHHHHHHHHHHHHHHHHHHH!!!!!

Scott, I am sorry about your experience today. That is tough and discouraging. MY congressmans office wrote me a letter yesterday that they contacted the NRB embassy and will get back to me when they hear from them. And, one of my fiance's coworkers who is a U.S citizen has a good friend at the Embassy he offered to contact her and see if she can give us any info. The waiting continues.

K visa AOS is 1050

Okay, I thought it was:

$340 EAD (I-765)

$930 AOS (I-485)

$ 80 BIO (Biometrics)

But again, I'm way out of my league with the Ks, and truth be told, had quite a rough ride with the CR-1

K and CR are different in fee structure... EAD and AP are in the AOS fee... no extra fee for those..

I485

Application to Register Permanent Residence or Adjust Status $1,010 ($930 plus a biometrics fee of $80).

Here is the reply from the Embassy to my Senator.

Dear Senator Bayh:

Thank you for your e-mail dated June 15,2010, regarding XOXOXOXOXOX immigrant visa cases. Your constituent, his fiance, XOXOXOXOX, requested your assistance in this matter.

Please be informed that even though the Adjudicating Officer deemed this case approvable, a mandator administrative processing was required before a visa could be issued to Mr. XIXIXIX. Unforunately, this is currently being carried out in Washington, D.C., and we have no control over this procedure and the length of time it requires.

We do understand the frustrating your constituent must feel about the delay in this case, but at this point, we can only advise your constituent and the applicant to be patient until we receive the results. Please recommend to them to continue checking with us periodically, preferably by sending an e-mail to :ImmigrantVisaNairobi@state.gov No additional steps are required by either Mr. XOXOXO or the petitioner at this time.

I regret not being able to provide you with a more encouraging reply at this time. Please do not hesitate to contact me again should you need my assitance in another matter.

Sincerely,

Bradford Hopewell

Immigrant Visa Chief

CSC is letting them expire.. then when you refile, they issue a NOID based on the previous K denial... this allows you to address the previous issues..but it also requires another round of fees at the new rate

Kenya is not on the MENA list.

On the list or not.. the case is undergoing checks at DC much the same as they do to most men from MENA

he cant work until they give him a work permit...so no that will likely not help... you may need to start planning on having a cosponsor lined up should one be needed at that stage...

Called DoS today for my weekly update and the lady recognized us.. she said Thuy is so pretty and when she accesses the case she sees her photo each time. she remembered us because of the photo.... still no change in the status... she was really friendly

At least time the person was not rude...It makes the process easier when you call and get someone who is nice.
