You can ask for your passport back, but it delays the visa being issued as the embassy then asks for you to return it, by the time you do, by the time it gets there, by the time it re-enters the system, perhaps by the time it re-enters the queue, by the time the visa is actually stamped in there...you get the picture :P

Yeah and there'd be no real point at this time, they give me enough trouble crossing when I had a job and a home, now that I'm unemployed, homeless and with a visa app in question, I doubt they'd let me across the border.

Gonna look into getting a temp job here, anything to pass the time..

Yeah and there'd be no real point at this time, they give me enough trouble crossing when I had a job and a home, now that I'm unemployed, homeless and with a visa app in question, I doubt they'd let me across the border.

Gonna look into getting a temp job here, anything to pass the time..

I agree - even though I had no problems visiting the US during the process, now I'm unemployed, living at home and in AP, I very much doubt they'd let me in...however having one's passport back does mean that one can travel to a third country to see one's SO. Perhaps not so practical for you, Kevbev, as you're relatively close in Canada, but for those much further away (eg 26 hours away!!) it does make life easier meeting half-way :)

he cant work until they give him a work permit...so no that will likely not help... you may need to start planning on having a cosponsor lined up should one be needed at that stage...

Called DoS today for my weekly update and the lady recognized us.. she said Thuy is so pretty and when she accesses the case she sees her photo each time. she remembered us because of the photo.... still no change in the status... she was really friendly

I thought at POE you get some sort of paperwork that allows you to work until you go through AOS.

Depends on what visa you are getting I think, K-1s don't get to do that anymore, I believe CR-1 is the one that allows you to work right away.

Timeline

CR-1s/IR-1s can work right away. The green card automatically comes in a few weeks. They have to apply for the social security card though.

The guide indicates you may receive an EAD (work authorization) stamp at the port of entry, but you STILL need to file the I-765 for the actual EAD card, as the stamp is only good for the first 90 days. Guide may be out of date though. http://www.visajourney.com/content/k1aos

2010-01-12 - Medical exam part 1 of 2 complete.

2010-01-26 - Medical exam part 2 of 2 complete. Ouchie!

2010-02-11 - Interview results: Administrative Processing 221(g) :-(

2010-04-27 - 2nd interview results: Approved :-)

2010-05-04 - Visa in hand!

Yep..out of date.. not able to work for at least a few months depending upon how long EAD and AP take... after the marriage you can file for them.. but it takes time...

Went to touch base with my congressional liason... As soon as I walked in the door he said ... what do you want? ... well I guess the consulate won that battle and wore him down untilo he gave up... He said he would send an inquiry 2 weeks ago, but lied.. DoS said no inquiry made by him in over a month... his second sentence was.. I have no update for you and will let you know when I get one.. bye... he could get a job at NVC easy with that type of attitude...

So I sent yet another email to the consulate begging them to finish the paperwork so we dont have to pay huindreds of dollars for another RT flight... taxis and hotel bill along with another fee for a new medical exam.. ours expires in a couple weeks.. only valid for 6 months... that means 300+ down the toilet because they are draggin feet...
