As long as The Consulate, NVC, USCIS are all following the rules.. there is nothing that the Congressman or Senator can do other than ask "whats up?" but if there is enough interest in the case.. after a while they may say,.. get this file out of here... My congressman has yet to get anything done, but when I hit the consulate with policy from the field manual.. they actually did something last week... its all about what the policy is and knowing that certain things take a while to get done and most aspects of the process have some form of time constraint built in....

Someone posted that article back when it first happened and it was obvious then that this is just a system that runs in a very screwed up way with no regard to those in the system... As was said.. it was just PR that got anything done... No government agency wants bad press...

Hi everyone please add our information to your list: K1-Visa - Morocco -interview date 5/19/10 - 221g giving and case returned to USCIS

Do anyone know how you can track case to find out when USCIS recv'ed?

I added you to the tracker just in case some people might question why you are on the AP tracker and the reason is that most people are on it for security and background checks but according to DOS any work that is being done on a case is AP. I hope this matter is resolved quickly and you dont have the same long wait that I have had.

Can you share with us what policy from the field manual you referred to? It may help the rest of us as well.

Thanks!

Here is a starting point for some reading... look at Kim's post in that topic for additional links...

Thanks ScottThuy---you are always very helpful. Well, today I contacted our local FBI, the senator and embassy. I'm so tired of this. I hope one of these entities are able to do something. But, I guess I know--none of them will do much. :( The waiting continues.....

Please take caution when contacting The FBI about this... You need to understand that this system does not work like any logical system works... When a file is sent to the FBI or DHS for additional security checks.. nothing, I mean nothing will speed it up... I seriously doubt that a writ of Mandamus would make anything move when it comes to DHS and FBI checks... anything that affects the processing of a security check can be considered an attempt to comprimise national security measures...

Poking at the FBI with a stick can make that dog angry... congress and Senate inquiries cant speed up the background checks, they can only get things moved offof desks when the checks are done.. instead of them sitting and collecting dust...

The DoS says wait 60 days before you make an inquiry if a case in in AP.. that the average is 60 to 90 days.... I know the past month seems like forever, but in the scheme of things its not that long...

User Name: AMit & Melody

Visa Type: CR-1

Country:India

Embassy: New Delhi

Date of Interview: May 27th, 2010

Reason: Beats the hell out of me, Hubby was approved at the interview, nothing was said or mentioned about AP <no slips or papers were issued, passport was kept> she actually told us that we would recieve the visa in 1 week or we could pick it up earlier at VFS. Called the embassy on June 2nd and was informed that Hubby had been put on AP and that it would take 4-6 weeks. I called again June 7th and the same Lady from the embassy told me that we are under Mandatory Administrative Processing, our case is currently being under review and to call back Friday or the begining of next week.

Sooo... I guess you can put me on your list... :( I would like to add that I never wanted to be part of yalls club.. I want to go back with the cool kids that dont have to sit in detention
