Do I need my Fiance's Birth Certificate to submit my I-129F?

If she has a pass port, not sure how China assign them, she has a State issued ID, does she ever need to show her BC.

If not, will she need it once here in the USA?

it might be needed for the visa interview later...

You do not need the foreign fiance's birth certificate or passport to file the I-129F. See the instructions for the documents needed.

Yes, she'll need a Notarial Birth Certificate for the interview and you'll want a couple copies for use in the US later. She'll need to get those from the Gong Zheng Chu (Local Notarial Office) as Notarial translations. If divorced, she'll need Notarial translations of her divorce decree and you will need those to file the petitions.

Closer to the interview, she'll need a police report and certificate of single status, both of which need notarial translation.

wow today i received my APPROVAL LETTER FOR THE ADVANCED PAROLE so here we go . i am waiting for my EAD card to arrive it's on the way i hope i will wake up tomorrow and find it in the mail box lol good like guys

It won't hurt a bit, and I did include it because I had it. However, the OP's fiance is from China and currently has no birth certificate to provide. There is no need to wait for her to obtain and mail one. He can go ahead and file the petition. She won't need the Notarial Birth Certificate until the interview.

Yes, you MUST have a photocopy of your fiancee's Chinese Birth Certificate in Chinese, a copy of the certified English Translation, and copy of Notarization. Basically, it's several pages stapled together: Chinese, English, Translator's certification, and notarization by the Notary Public. This is how it must be done for someone from China.

Your fiancee will take the original birth certificate to a visa interview (so you submit only copies).

All other similar personal documents (e.g. divorce decrees, etc) must have notarized English translations.

In addition, if they have a passport, you can add a copy of the first passport page.

Again, the question on the table is whether the foreign fiance's birth certificate is needed when filing the I-129F. The answer to that question is NO. The OP has already been directed to the appropriate local agency in China (Gong Zheng Chu) for the needed Notarial documents, none of which will be needed until AFTER the petition is filed and approved. Some can be obtained now. Others are best obtained closer to the interview.

The only Notarial Translation Document that would be needed for petition filing is a divorce decree, if any.

As said many times before by everyone else.... the petitioner is the only one who should send his birth certificate with the I129F. Both sides need to be copied. The foreign fiance will need one for the interview and stages later on in the US. Get several copies, there is plenty of time until the interview.

Thanks everyone for your input. I am planning on submitting my petition in Oct after my return from meeting her Mother and Father, and officially asking her to marry me in front of her family and give her my ring.

We met 3 years ago while I was in Beijing and I though about having her come visit the USA then but it got too complicated. I went back again this spring for 2 months and decided to take the jump.

I feel like I'm falling in a black hole with only our government to save me. Talking to her for an hour everyday on Skype helps.

I'm sure I will have other questions as time goes on.
