K2 question - Permission letter from mother

I'm having a hard time finding much K2 information. I'm looking to see if anyone knows or has an experiences of a K2 denial/approval without a letter from the mother giving permission to the father to bring the child to the US? The mother in not in Jamaica, but living abroad illegally.

What are the current custody orders from the court?

There are none. The couple was never married nor have they ever filed anything in family court in JA. The father's name has been listed on the birth certificate since the child was born.

Best question is to ask the consulate what they will accept but without a letter, in many countries the other solution is some sort of judicial action (declaration of parental abandonement)

TL; I just asked my cousin what he did. He was asked at the interview and told the CO that he has not seen his kids mother or heard from her in 7 years. He also had a letter from the children's grandmother.

I believe the rule is that if you have full custody of the child, you do not need a letter from the other parent. If you have joint custody, you do require a letter.

You could make an infopass appointment to ask their opinion on this situation.

An infopass appointment would not be too helpful here since the consulate is making the decision not the USCIS

I cannot answer this for people going through Jamaica but in Colombia the CO makes sure that at least one parent is present at the time of the interview. Then DAS (Colombia's national security agency) will need to see a recent permission slip notarized and signed by the parent not travelling with the child before hopping on the plane. If people don't have this permission slip, they don't even let the child board the plane.

Agreed, I forgot that each time we have tried to leave Ukraine, the permission slip was reviewed. So it may not simply be a consular requirement.
