K2 SSN?

Hello Everyone,

My fiancee and her 11 year old son are here now in the US with me. It has not been an easy transition for any of us (more on that later). We've applied for a Social Security Number for my fiancee but could not get one for her son. They said he needed an EAD. I am unsure of how to get this for a child (if it's even possible). If anyone has any ideas...

I dont think that it is imparitive that he gets one now. You only need one when he will start working, which isnt for a couple of years now anyway. By that time, he will have his green card, and it will be a non issue.

You can file for your EAD when you file for AOS, but I dont know if they will give him an EAD, since he is too young to work for a business.

02/09/09 --- 2 Yr Permanent Resident Card Received

11/10/10 --- Mailed I-751 packet to VSC

11/12/10 --- NOA1

12/22/10 --- Biometrics

03/15/11 --- RFE

05/10/11 --- Approved

There's also tax filing to consider, though it is possible to get a taxpayer ID for him instead of an SSN. But when you apply for AOS, you have to pay for EAD and AP anyway, so why not just fill out the paperwork and send it in with AOS? Then he'll have his EAD and can get his SSN right away. Just my opinion, of course (and is what I'm doing for Natasha's 11 year old daughter).

Just wait for the conditional greencard to come. There is no other reason for an 11-year old to have a SSN. Once he has the CGC, go apply for the SSN if you feel the need.

SSN is used nowadays for more than work purposes.... If the CGC will not arrive before tax filing or if you want to open a bank account or start a college savings plan you may wish to submit the I-765 in addition to the I-485 when time comes... No additioanl cost other than passport photos...

Yes, I have done all these things. Why can't it wait 6-8 months? What is the rush? My daughter has her SSN now, but it wasn't a big deal.

It is not about the rush or relaxing... It is all about telling the OP what his/her options are ... instead of a simplified "There is no reason to do this" when in fact there might be...

Ok then, EAD is easy to get, go get it. A TAX ID number can be applied for with your return. Just like these other folks have mentioned.

But you still got plenty of time... I would relax if it were me (again) :P

The people at the SSA office are about as knowledgeable on immigration as the folks at USCIS are on Social Security. They just don't know.

I took at least 8 trips to the SSA office here (so many we got to know the security guard) to get my wife's card/number all straightened out. Each time it was a different reason but basically it boiled down to this - whatever it says in the SAVE system is what they have to go on. Right now, you have an 11-y/o with a visa good for three months. Wife up his mom and you may get somewhere. Maybe not, as they still won't be updated in SAVE until they get their NOA I from applying for green cards. Once they get that, you can take that back to the SSA office and maybe they'll give you a number then. Maybe not.

Good luck, and as said above... just be patient as this is going to take a long time.

If it's for tax reasons or insurance, etc., use the kid's A-Number or get him a Tax Payer ID number. Easy enough.
