You should be able to simply write a letter explaining why you weren't required to file taxes. My USC husband has been unemployed for 3 years so didn't file, and a short paragraph explaining this was accepted no problem.

Bye: Penguin

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

You need to get "proof of non filing" statement from IRS if you didn't file taxes, and write a little note explain why you didn't file taxes i.e. didn't meet the income requirement to file taxes?

Do you work currently? If you current income (2008) is expected to meet the poverty guideline, you need your recent paystubs and an employment letter stating your position, salary and starting date.

If you currently don't work or do not expect to meet the poverty guideline, you need a co-sponsor.

You fill up I-864 as a principal sponsor (petitioner is always the principal sponsor) and the co-sponsor fills up I-864 if she/he doesn't live in the same household, the co-sponsor fills up I-864A if she/he lives in the same household.

ok so a simple letter explaining I was a stay at home mother and havent worked is fine?

I also have another question....

I have 5 kids in my household. One I have no legal gaurdianship over and she is in the process of emancipation from her birth mother, my son is turning 19, 2 girls that my ex claims on his taxes and one one 16 yr old that I claim on my taxes. So when I am filling out this paperwork, I only claim the one child as my dependent even though all of them are living with me? correct? I am so new to all this stuff.

An eye for an eye makes the whole world blind.

I think you will need more of a reason then just at home with mother unless you can prove that by working you will jepordize her health. Otherwise get a co-sponsorship. Claim only who you usually claim on your tax (if you usually claim only 1 dependent, then claim only one.)

To explain why you didn't file taxes, you need to have "do not meet the income requirement to file taxes" somewhere in the letter. You need to request the "proof of non filing" from IRS to attach to the letter.

It's free to request the Non-filing statement from IRS, you can call and they will mail you within 1-2 weeks.

Here is what my husband wrote about not filing for taxes- different reason but you can change that (we didn;t have any non-filing statement from the IRS):

To Whom It May Concern:

I am Mr Penguin, Penguin's husband and petitioning sponsor. I did not file an income tax return for the years 2005, 2006 or 2007 because I have not worked during my 3 year residence within the Republic of Ireland. Once I came to Ireland, I was unable to find work and so used savings; I was maintained by my wife upon her income and savings. Since I made no income for these years of any type, I was not required to file an income tax return with the Internal Revenue Service.

Sincerely, Mr Penguin.

In regards to the household size, I think you are correct in that your currrent household size is 2 (you and the 16 year old), as you do not claim any others on your taxes/ pay child support for them. But I am not 100% sure.
