hi

before i file AOS for my wife do we need to get get her name changed with SSA first? then file AOS or can we file the AOS now with her current SSc? the current SS card has her madien name.

N400 sent : 2011-11-18

N400 received & check cashed : 2011-11-28

N400 interview letter revcd: 2012-01-23

N400 interview: 2012-02-29

N400 oath: 2012-03-21

SSA will not allow you to change your name to your married name since you currently will have an expired presence of legal status in the US after your I-94 has expired (which is 3months from US POE). I tried your method and even showing them that I applied for AOS and that I had my marriage certificate showing that I married, will not be honored by SSA as my I-94 expires in 3months. You can only change your name when you have EAD approved and they verify it through USCIS. The process took about 1 week after receiving my EAD card and goin to SSA local office the day after I received my card. I received my new SSA card within this timeframe.

That is not always true, we walked in to SS office with Passport with K1, birth certificate and marriage certificate and my wife got SS card with her new married name. Seems like it depends on the SS office location.

Sometimes you gota say hokey dokey to destiny.
