She (the joint sponsor) needs to include her husband in the household size. Her husband needs to fill out an I-864A if they filed a joint-return. However, if the husband is not willing to let the joint-sponsor rely on his income, that is acceptable. In this situation, the joint-sponsor needs to show her own income and which portion of any assets used to qualify can be attributed to her.

The son would only be included if he is still listed in her income tax return as a dependant. Also any other dependants listed on the income tax return should be included in the household size.

Don't forget about the requirement that there be a signed Form I-864 from the petitioner with their most recent Federal tax return (or proof that there was no obligation to file). The petitioner, as well as the joint sponsor, has full financial responsibility for immigrant(s) they sponsor.

Thank you very much for your answers. Infact I had interview already but the consular told me that I needed a joint sponsor. We thought that our I 864 was perfect because my husband current annual household income is above poverty guideline. I am still confused because it says (on 24 page 4 of I 864 Form) that the current annual household income will be compared to Poverty guideline, then why I still need a joint sponsor. Anyway it might be our misunderstanding.
