Well all you can do is keep trying. Try to figure out what the problem was and go from there. Maybe it has something to do with you canceling the first one? I do beleive the just changed some rules in March to better screen the US citizen when applying. (especially men) I think one red flag is those who apply more than once in "a certain amount of time". Im not sure how long they made the cooling off period between applications.

But doesn't that rule going to be applied to one petitioner applying for two different beneficiaries? Looks to me as if the OP is applying for the same beneficiary

The law refers to approved petitions and from what the OP is saying the first was cancelled and this one was denied due to the evidence of having met being outdated.

Upon approval of a second visa petition under section

101(a)(15)(K) for a fiance´(e) or spouse filed by the same United

States citizen petitioner, the petitioner shall be notified by the

Secretary that information concerning the petitioner has been

entered into the multiple visa petition tracking database. All subsequent

fiance´(e) or spouse nonimmigrant visa petitions filed by that

petitioner under such section shall be entered in the database.

As you havent yet received any information from the service center re the denial, I would suggest only taking your representives statement to start all over again as 'his opinion' and not factual. The service center may very well give you info on 'appealing' or reopening your case' and which form you need to complete in order to do so. This usually requires you to then submit new evidence. Not saying this is a definate, but I would definately wait to hear from the service center.

I agree with aussiewench, you need to wait for the letter from the service center before deciding what your next step is. As has been mentioned, the normal action of the service center is to issue an RFE in a situation where the submission is incomplete. Perhaps the congressman's aide has misunderstood what he/she was told and then told you that you have been denied, when in fact you are getting an RFE.

Call the USCIS again and ask them what your status shows as now, and mention what the congressman's office told you.

Can you see what your status is on-line?

You mentioned that USCIS told you that your prior evidence would be sufficient. Did they give you this information in writing?

You mentioned that you cancelled a previous submission. When did you submit that petition? What was the date of meeting that you used in that first petition.

Since you have to submit photos of both parties with the application, it is fairly easy to see that the people in the 'meeting' photos are indeed the sponsor and the beneficiary. Also, these photos will be matched later with official government photos such as from passports. For this reason, I always saw photos as primary evidence.

Whether the photos submitted as evidence are easily seen to be the same people as in the passport style photos is of no relevence. The evidence submitted must show or support other evidence of having met in the required 2 year period..not that they are the people in question.

Taken from a members post of received RFE where photos were submitted.........

MEETING IN PERSON: Though you have submitted photos, they alone do not establish that you have met your fiance in person within the two-year period. therefore, submit evidence of meeting between you and the beneficiary in person. the primary evidence may include copies of passport pages that show the identification page and admission stamps military orders letter from Commanding Officer, or any evidence that will help the Service to determine that the petitioner has met the beneficiary within the 2 yrs. "

Ok thanks for clearing that up.... I thought the law was put into place to reduce petitioners applying for multiple beneficiaries.
