rejected!! =(

hi guys =(

we got rejected =( for our K1 visa

around 3 weeks ago i explained in this forum that we re already waiting for 7 months for any answer.

many of u adviced us to contact the house of representatives. so we did and they immidiately got to work. and now we got a letter from them saying that the immigration denied our application =(

the problem is that this is our second application as we had to cancell it 2005.

now they are saying that the prove was outdated (funny how they realized that just now, telling us in the beginning that they dont need any new prove)

they are saying we have to apply again.

now i am worried that they are gonna let us wait again for 7 months.

so has anyone gone through that?

should we contact a lawyer?

or contact the congress again?

would it be a good idea for him to come to germany to marry me and so that we apply for the other visa?

this is so horroble!

we re together since 1999

Jan. 2005: filed for K1

March 2005: NOA 2/ August Interview

May 2005: had to cancel K1 =(

Sept. 2005: filed (again) for K1

May 2006: contacted house of representatives- for help

19.May 2006: received letter from member of congress that they have found out that our case has been denied due to outdated proof. We never received any info from the service centre itself; they did never ask us for any new additional proof or information

19/20/21..Mai 2006: LOADS of worries!!!

22.May: first contact with immigration lawyer

30.May: email from USCIS: petition approved March,11,2005- petition referred to National Visa Centre for processing- Petition referred to Consulate- Department of State did not issue a visa!

June 2006: applied again for K1 with the help of congressman

Sept 2006: contacted senator...no further help

Febr 2007: still no info---nothinggggggggggggggggggggggggggggggggggggggggggggg

well you need an attorney. because, for whatever reason you cancelled the application for last time

is certainly playing a role now. plus with the new IMBRA law - yeah I would get an attorney

get an attorney and hopefully you will not have to g through this type of hell..note>> make certain the attorney knows the process and issues..allot of supposely immigfration experts,. have no clue beyond the obvious

This is very true. I consulted with an attorney before I started my process and the guy didn't know much at all. Said he had the research resources to look up and apparently that's what I'd be paying him for. Needless to say, beyond the fee for that initial consultation, he never saw a penny of my money.

Obviously i'm no expert and can't offer (nor am I trying) legal advice BUT this is how it seems to me.....

You said they said, "the prove [proof] was outdated".

If I remember correctly, they need proof that both of you were together (meaning that the two of you met in person) within the past two years.

I am assuming the proof you submitted is now older than two years.

I think you should reapply but first, you will need new proof.

You will have to meet again, probably immediately before you re-apply, collect ALL of the evidence you can of your meeting - A copy of a visa, receipts where you exchanged currency, plane tickets, hotel receipts (if you are going to a country other that your fiance's country, it must have your fiance's name on a receipt too for the same time frame and location -city/country).

Photos are your secondary evidence. I wondered why they told me this before and I thought about it. The person in the photo could be ANYONE, how would they know BUT if you have evidence showing that he visited your city, then that would remove much doubt from their minds.

Also as secondary evidence, keep copies of your phone bills, emails, and any other communications you have.

You probably already know these things but I just wanted to be sure and I hope something here is helpful to you.

If your evidence was too dated they should have sent you an RFE (request for info) so that they can update their files. This would have been the proper way to handle it.

I would certainly see if there is any legal recourse which would allow you to simply submit new proof now on the same application.

I am a little confused....did the Embassy in Frankfurt deny you or the service center?? Like are you talking about your petition or your actual visa after your interview and everything?? that would help me to give you some advice, because I was under the impression that a service could not flat out deny you the visa only send an RFE and that only after the interview could they determine to not give you the visa...correct me if i am wrong!

Well all you can do is keep trying. Try to figure out what the problem was and go from there. Maybe it has something to do with you canceling the first one? I do beleive the just changed some rules in March to better screen the US citizen when applying. (especially men) I think one red flag is those who apply more than once in "a certain amount of time". Im not sure how long they made the cooling off period between applications.

I don't have any advice, I am just sorry to hear that you've had so many obstacles in the way :( I hope if you re-apply you will have better luck!! You've been through enough already (L)

I would definitely seek out a good Immigration Lawyer.

From what we've seen here on VJ that the consultant could have kept the case open.

The process of sending the approved I-129f from the Service Center (through the NVC) and arriving at the embassy takes about a month. The fiance(e) has 4 months from the time the I-129F was approved at the Service Center to obtain the K1 Visa at the US Consulate in the foreign country. This time period can be extended by a consular officer if required. The visa application process is generally similar in all countries, although each Consulate will vary a bit in their requirements. Every K1 applicant will have a unique story to tell about how they got their visa.

But doesn't that rule going to be applied to one petitioner applying for two different beneficiaries? Looks to me as if the OP is applying for the same beneficiary

thank u for trying to help

we applied for the K1 in september 2005(the second time as we had to cancel the first time due to personal problems) anyways...they told us we dont need to apply again but they will review our first application. so we got a new code and everything. they told us we dont need to send them any new proof.

anyways...we didnt hear from them for 7 months. nothing! no RFE no info about our case. we called and all they sayed was that the case is being worked on.

a few weeks ago we got really worried so we contacted the house of representatives. Mike got on the case immidiately and jsut yesterday we received a letter from the house of representatives (not the service center!) that the service center told them our case has been denied. supposevly the proof was outdated. and that we have to apply again.

we still didnt get any kind of notice by the service center

the first time we applied was in january 2005, so our proof wasnt really that old.

i know that the reason for those problems is the fact we cancelled the first one. but we didnt have a choice then.i guess we re gonna follow the congress advice and apply again =( but with some controll by mike

i just hope that this time it is gonna go faster
