Timeline
Have you thought about moving to Vietnam for a short time until you get all of this straightened out? I know that Xuan and I are waiting for Packet #4 and if for some reason she is not apporved and we have a fight on our hands I have given serious thought to moving there for some time just so we can be together. Not sure how just yet but I am hopeful that we will not have much trouble with the Interview. BUT with this consluate you never know. Good luck and I hope all goes well.

Yes, I have certainly considered moving there if she will not be allowed into this country. It is ashame that we as American's have to consider this as an option.

Sorry to hear that your visit to the Consulate was unable to straighten things out. However, keep up the pressure. You should be calling and/or emailing the Consulate to check on your status at least once a week of not more. Make sure to talk to an American CO as the Vietnamese staff will just give you stock answers. Also send letters to the Chief of the Consulate to explain to you what you can do to straighten this out. As a US Citizen you have the right to talk to anyone at the Consulate, including the Chief.

Until you get your pink slip, don't stop trying.

We hope you get a positive answer soon.

As instructed, I have been running everything through my Congressman and Senator. Today I received some saddening news from my Congressman that the consulate is proceeding in returning the case back to USCIS. There was no explanation or anything in the letter from the consulate as to the reason why. I am just hoping that this was a mistake and the case is still being considered. My fiancee received a call last week from the consulate asking her for the case number. She did not have it at the time so she called the consulate the following day with the information. The clerk told her that the case was reviewed and was being sent back. When I spoke with my Congressman, they were still under the assumption that the case was still being reviewed and that a decision hadn't yet been made. Well my Congressman inquired about this to the consulate, which is when I received the bad news. This is such a traumatizing roller coaster ride when all we want is to be together. What ever happened to this being a free country to all? I understand that there have to be certain restrictions but to what extent? We have provided enough evidence that should prove beyond a reason of doubt that we are true in our relationship. The embassy in Ho chi Minh appears to me to be run by Communists. My Senator told me that the USCIS is currently working on cases sent back in 2004!! That may mean years before our cases is even looked at if it is sent back. :angry: I don't know what to do, as this whole system is broke and in dire need of repair.

I am sorry to hear your case was sent back. It is a very difficult time for you and your loved one but you must not give up. Our case was sent back in 2006 and my wife is here now. You have to continue building your case for when it comes time to appeal the consulates findings or submit a new petition. (I am not sure what Vermont does with returned petitions.) There is a pinned thread in MENA about returned petitions that may help you. I wish you the best J&Q.

I know that feeling your experiencing...of being at the whim of a large faceless system thats preventing you from achieving your goals. It can be frustrating, confusing, and a bit maddening! BUT don't forget, its just paperwork and it'll eventually get sorted out in the long-term...it just may mean that you have to adapt your short-term goals in anticipation. In other words, if possible, spend more time with your loved one and continue building your relationship, and possibly spending more time with her in VN! If she can't be here, and you are married already...why not be with her in VN while you wait? Many times I thought about it while we waited for the embassy to get its act together (instead I ended up having to push them a bit with a lawyer too).

Again, I'm sure this news feels like a swift kick to the gut, but it'll go away and you'll still be here and she'll be there, both angry and confused, why not be with her to shake your fists at the system together?

I appreciate everyones support. I am always amazed on how much VJ Members help out other VJ Members. I really wish that I could move to Vietnam to be with my sweetheart but as per my thread above, I have commitments to my family here. She also does not want me to move and abandoned my family due to their situation. We have agreed that we would give it 1 year and if all does not go well by that point to look into the possibility of me moving there. I think that the most difficult thing through this whole ordeal is just waiting not knowing what or when a decision will be reached. Reading through other VJ Members threads, it appears there are many of us going through the same situation. In the meantime, we are doing our best to remain positive and hope for a positive out come one of these days.
