Hi All,

I want to find out from everyone, on what should be the best option for me.

I am a US Citizen and engaged to my fiance a Canadian citizen and we would like to sign the married pretty soon in Canada.

What I want to find out is, which method of application should I be file under? K1 or K3. If i am going with K1 application and can I sign the married license before the K1 application finished?

or should I go with K3 application but assuming K3 I have to provide the married certificate.

Please see the guides. K1 is for fiance(e) and the marriage must occur in the US after the visa is issued and used. If you wish to marry in Canada, you marry first, then file a petition for a spouse visa.

If you are not married now, and wish to marry in Canada, you must wait until after the marriage to file anything.

You have another active thread on basically the same question...

Marriage in Canada = K-3 or CR(1). Period. Under no circumstances can you marry in Canada and enter via a K-1.

If you marry in the USA you will utilize a marriage license from the local government in the state you are getting married in.

You cannot get married in the USA with a Canadian marriage license.

Hi Binh,

K1 is only if you are not married, so you can not get married while filing the K1.

K3 is only if you are married (there is also CR1, but for K3 you are married and you

file an I-130 and when the I-130 is received (NOA1) than you file I-129F ,and than

wait.............. :blink:

If i am to get the married license in Canada, would filing the K3 be appropriate or the US immigrant would allow or accept Canada married license?

What you need is a marriage certificate but yes, of course, US accepts legal marriages from other countries.
