Hi All,

Thank you very much for this forum, at first I am very much lost in term of what to do and was about to get an immigration lawyer and some how I was able to find this forum which provide more information.

What I want to find out and ask everyone is, I am a US Citizen and engaged to an Canadian citizen and I am about to file the K1 application to bring my fiance over to the USA.

Can I go ahead and get the married license certificate in Canada while the K1 application still in process or do I have to wait until the K1 application resolve then get the married license in Canada.

Or should I go the route with filing K3 for spouse instead of K1 Fiance? Any pros and cons?

Is it matter if the married license sign in Canada or USA?

The marriage must occur AFTER the K-1 visa holder has entered the USA... so the marriage MUST occur within the USA or its territories... so there is no signing of this document IN CANADA...

The marriage must occur AFTER the K-1 visa holder has entered the USA... so the marriage MUST occur within the USA or its territories... so there is no signing of this document IN CANADA...

If you decide to (or want to) get married in Canada, then you would apply for a K-3 (non-immigrant spouse visa) or CR-1 (immigrant spouse visa).

If you start the K-1 process and then become married, you will have to start all over...there is no transferring from K-1 to K-3.

K1 marries in the USA after obtaining a visa. If you wish to marry in Canada, then you'll need to take one of the Spouse visa routes.

No marrying in Canada on a K1.

A K1 is for a foreign fiance wanting to come to the U.S. to marry and live with her USC fiance.

Please read the Guides and the K1 Flowchart that shows you exactly what happens during this process.

Once your fiance has the K1 in their passport, they have to move to the U.S. within 6 months of it being issued and then you have 90 days to marry and the marriage must take place in the U.S.

Don't even worry about a marriage license now, remember, a K1 is a fiance visa, not a spousal one.
