Timeline

in late may we summited the form i30-i31- i485 and 765, got married in april / i enter on a tourist visa b2 we live in san diego / 13 miles from the border /unfortuanelly my i 94 expired on 03/20/2008 im still waiting for the EAD and AP our lawyer advise that i acumulated like 60 days of ilegal presence so the AP wont help me to go and visit family and relatives.also i was under the impresion that if i travel more than 20 miles inside the us i would need to have a valid i 94... after we get the noa2 for the i 30 what is the next step?

anyone in the same boat as i do? any idea of timeframe :crying:

If you filed I-130, and I-485, and you have I-485 receipt letter, you are in a holding status, "AOS Pending" illegal presence wont accrue until after a decision is made on the I-485, this is the NORM for all AOS persons, especially persons entering the USA on a K-1 adjusting status.

To travel within the USA you only need photo ID, your passport, this has no effect on K-1 visa holders who have expired I-94, and wont have any effect on you either.

The I-130 is tied to the I-485, you will be scheduled for a biometrics for the I-485.

This post belongs in the Adjustment of Status forum. You are not applying for a CR-1 or IR-1 visa, you are Adjusting Status.

You might consider staying away from the airports as TSA checkers are now beginning to selectively verifying immigration status. Not that you are illegal, it just may take some time to explain if you are selected.

thanks alootttt actually the bio appt was done on june 19th for the 485 and 765 the the receipt has already assigned an a#1234566 ? i tried to call the msc to see if theres any update on 765 and for some reason they say my receipt # is not valid any idea? :unsure:

There are some people that go throughout their AOS process w/o their receipt # functioning, the only thing left to do is to wait. You are still within the waiting period, which is of 90 days. After the 90 days, you can go ahead and schedule an infopass appointment to check the status of your case. They have to come with a decision in around no more than 90 days.

Check my signature, I received my EAD 3 months after I submitted my application, just be patient.

Thanks for the info but you know the waiting is always a killer specially if your are not working
