Financial question for K-1 visa

Timeline

I have filed for the K1 visa and have received the NOA1 and waiting on the NOA2. I am currently a graduate student and my fiancee is working in China. I will also be employed soon, earning $24,000 per year (this is not a temporary position, $2000 a month). Income wise, I have never been over the poverty line until now. My fiancee will probably have her interview around February or March.

My question: Will I pass all the financial requirements set up by USCIS?

Any advice would be greatly appreciated. Thanks.

06/07/2008: NOA1 received

07/02/2008: touched

12/28/2009: I-485, I-131, I-765 application sent vis Fedex Overnight

01/05/2010: USCIS received.

01/08/2010: Receipt letters received.

Call USCIS and apply for an expedited AP.

Make appointment through INFOPASS on USCIS website with local immigration office.

01/15/2010: Meet with local immigration officer and get the printed biometric appointment letter(appointed date 02/11).

01/19/2010: Walk in and get biometric done at local ASC.

01/22/2010: Receive AP.

01/28/2010: Receive Employment Card

04/12/2010: Interview at 8am. Passed with no approval letter and no I-551 stamp. I was told there was a clitch on the name check and some delay could be caused to the final approval.

04/13/2010: Card production was ordered! I got sms update right after 8am!

04/23/2010: Green card in the mail!! God is good!

* 3 years tax returns (1040's). 3 years W-2's (if you are not self-employed. Recent pay stubs, at least one within 30 days old. Letter of employment from employer on letterhead stationary, stating job, wage rate, and length of employment.

(If you are self-employed, letter of employment on your own letterhead and a bank statement in your company's name.)"

Does this mean I had to have been above the poverty line for the last 3 years?

Does this mean I had to have been above the poverty line for the last 3 years?

No.

When the time comes provide all the required and best practice supporting documentation but state your current annualized income and put your employer letter and pay stubs on the top of the pile of supporting evidence.

You should be OK, IF you are a family of 3 or less. The cutoff for a family of three is $22,000 currently but this will be adjusted UP next March. I went through this over and over. I was self employed until late 2007 and now have an employer and earn WAY over the minimum. I was alittle worried because my self employed income for 2007 was BARELY over the limit for a family of four (our family size). But I have since learned this...

1. They go by GROSS income, NOT adjusted gross.

2. They consider FIRST current, verifiable income. Bring a letter and check stubs from your employer

3. The tax return is basically fluff if you have verifiable employment income, they didn't even look at mine.

4. If your verifiable income at the time of the interview is above the standard, it is fine and you do not need any other assets, bank information, NOTHING except last years tax return.

Relax, sounds like you are fine.

I am in China. Above messages were posted by my fiance in the US. We are sharing the same account. I am sorry if you felt confused,hehe. I have been on the board for a couple of months and I notice that pushbrk has been doing a great job helping others. Yes, a current income of $24,000 for a household of 2 is enought for both a Fiance visa, and then later for adjustment of status.

Current federal poverty guidelines for 2008 require you to show that your current income is above poverty line (not your income in 2007 or 3 years ago, but your income now). So you should be good.

For a fiance visa it's 100% for a household of 2 - above $14,000

For adjustment of status (later in USA) it's 125% - above $17,500

For a family of 3 it's accordingly:

100% - $17,600

125% - $22,000

You make $24,000 - you are clearly above these minimum income requirements.
