I-864 Affadavit of support

Hi everyone, i am in the middle of processing my AOS package for adjusting from marriage with my wife (USC) while i am on the VWP. Today my sole sponsor (my mother-in-law) filled out the I-864 form per the instructions. However, before i put this form as completed into the package there is something i am a little concerned about, the number of Dependants. In this household there are 4 people living here, including me. There is myself, my wife, my sister-in-law and my mother-in-law. She listed me as a dependant and 1 dependant child in my sister-in-law. She said that now my wife is married to me it means she is no longer her dependant, is this correct? Or should i have her change it to the total of 2 dependant children. (her income still covers it, its over 60k)

Furthermore i see in the forms there is her 2007 tax return attached to it. I see 2 pages for the tax return itself, on that says Schedule A for Itemized Decuctions, one for Education credits, one for Residential Energy Credits, and then one that says Supporting Schedules. I am confused if this is all the right forms, (does it include the W-2 or whatever one is needed?) I am from England and confused if this is all.

Anyone who can help me and my wife we would really appreciate it,

Hmmm....when your MIL files her income taxes, does she claim your wife as one of her dependents? The co-sponsor has to claim all those that are dependent on him/her in the household, including you. I'm not sure what your MIL means by "now that her daughter is married to you that means she is no longer a dependent".

Her 2007 tax return showed my wife as a child dependant yes, but we got married August 2008, this month, so im guessing her next one will not.

I guess it would depend on her recent filings. Since she claimed your wife as a child dependent and the 2008 tax season isn't here yet, she will have to include your wife as one of the household dependents. At least that's the way it sounds to me. So it seems that your MIL will need to look at the income level for a household of four.

She earns $68,000 a year, i dont think this is a problem is it?

I just realized, can i even use my mother in law as my sponsor? She filled out the I-864, but ive been told on another forum that my wife has to be my sponsor, and then the mother in law the co-sponsor, would this mean my wife has to fill out the 864 while her mother fills out the 864a? Grrr?!!
