Another question

This situation seems a bit tricky to me, so I know you guys will have the answer.

My wife is the USC and I'm the CDN. She will be using the I-864 since she is the spouse. Now since she is currently living with me on a visitor's visa here in Canada and is not working we will be using her Dad to co-sponsor.

The question is, does her Dad use the I-864 or the I-864A form? Because she is living here in Canada right now but technically she is still a resident of the US at her parents address.

Does this make sense to anyone and can you help?

The co-sponsor files the I-864A and the petitioner has to file for I-864 regardless of any income or residency. Hope that helps.

I'm the same. I made my mom fill out the regular I-864 because the way I read it, she doesn't claim me on her taxes and I don't plan on using her income to support myself or my husband, and I don't plan on living there long after he comes. I guess I will find out if its ok since it was just sent earlier this week

I-864a is only used by a household member so is correct in this case but DOES depend on whether the residence address is the same.

If the co-sponsor lives at another address or otherwise does not qualify as a household member, they use the I-864.
