I-864 and I-864A confusion

I am currently suffering from adjustment of status mental block and need help with the Affadavit of Support forms.

My husband is a student earning below poverty guidelines and has completed I-864.

His mother, who we are residing with, is our co-sponsor and earns above the poverty guidelines.

We have completed an I-864 for her but are wondering about;

1) is the I-864 sufficient?

2) should the I-864 be accompanied by an I-864A?

3) The instructions on the I-864A state that the sponsor completes parts one and two and that the household member completes part 3. I don't understand why it is the sponsor's income here which is important when he cannot provide sufficient to meet the poverty guidelines.

I am just getting really confused by which forms should be filled out and by whom. Thanks for your help.

You will need both an I-864 along with an I-864A if your mother-in-law is a co-sponsor.

The reason that your husband has to fill out the I-864 is because...he's your SPOUSE, or rather that HE is the petitioner, not your mother-in-law.

While your mother-in-law could in theory petition for your immigration, it would have a much lower status as compared to being petitioned by your spouse.

That does help. So an I-864 for each of them and one I-864A as a contract between them?
