hi all

I got RFE's for 3 pieces of evidence! It's really easy... the other two i think they messed up. I am a K-1 visa holder from Canada and had my medical completed for the K-1 process. The documents from the medical I surrendered at my point of entry. I got two RFE's, which seem contradictory to me... see below:

RFE #1

1) .... you need to submit a properly completed and signed Form I-639, Report of Medical Examination and Vaccination Record, (Rev. 04/02/08 or later) for the applicant on Form I-485. The medical examination must be conducted by a civil surgeon who has been deignated by USCIS. The medical must be issued less than one year prior to the filing date of Form I-485.

RFE #2

2) You have submitted Form I-693, Medical Examination of Alien Seeking Adjustment of Status. However, you failed submit proper documentation of immunization for the Form I-485 applicant.

I am very confused because #1 says that I dind't submit I-639 and then #2 says I did. Also, can someone tell me am I supposed to have documentatuon of immunization or would I have given that at POE as well? Also what does it look like?

Another question, I decided not to apply for approval to travel because I thought this woud be done relatively soon but now that I have these RFE's I'm thinking I should file that form. Is that for a one time leave/re enter or for multiple?

Timeline

AP (Advance Parole) is good for multiple entries and is valid for one year. It usually takes anywhere from 60 to 90 days to get approved.

After you return your RFE documents (for the AOS), you could get approved shortly after they receive them. I got an RFE during the K-1 process, and was approved very quickly after they received the requested documents.

Sept. 2/08... Oath Ceremony

Sept. 5/08... Sent in Voter Registration Card

Sept. 9/08... SSA office to change status to "U.S. citizen"

Oct. 8/08... Applied in person for U.S. Passport

Oct. 22/08... U.S. Passport received

DONE!!! DONE!!! DONE!!! DONE!!!

KAELY (K-2 Visa)

Apr. 6/05... DS-230, Part I faxed to Vancouver Consulate

May 26/05... K-2 Interview - APPROVED!!!!

Sept. 5/05... Entered U.S.

Sept. 7/05... I-485 & I-131 sent to CLB

Feb. 22/06... AOS Interview - APPROVED!!!!! (Passport NOT stamped)

Dec. 4/07... I-751 sent to NSC

May 23/08... 10-Yr. PR Card arrives in the mail

Mar. 22/11.... N-400 sent to AZ

June 27/11..... Interview - PASSED!!!

July 12/11..... Oath Ceremony

Hi! It's hard to tell from your timeline when you had it done... (Please fill in your timeline.) When did you have your medical? If you had it completed more than a year ago, it's expired.

Two... did you submit an I-693 with your vaccines transcribed?

AOS & getting the SSN & the I-693

6/13/08 Applied for SSN for David ----- TRIP 1; 6/23/08 Went back to SSA 'cuz the person didn't pc all documents (rec'd letter from them) ----- TRIP 2

7/2/08 Received David's health insurance cards! Yay!

7/3/08 Went back to SSA; they said come back 7/9 if he still hasn't received it ----- TRIP 3

7/8/08 Got list of vaccines he still needed from CS by fax/phone; tested for immunity to MMR (only vaccine still needed) at our family dr

7/9 & 7/10/08 Went back to SSA, card still not received - Denied opportunity to apply for replacement ----- TRIP 4; Went back to SSA again to apply for a replacement card - Talked to a supervisor this time, POE people entered his last name incorrectly ----- TRIP 5; went to get David's ID thru the State, denied - instructions wrong on website; measles test inconclusive, another test needed; requested new lease

7/14/08 SSA called me in regards to problems at local SSA office

7/15/08 INFOPASS appt to fix POE name input error and then went to airport to fix POE name error

7/17/08 Received SSN card in mail and went to get state ID

7/21/08 State ID received in the mail and tested again for measles immunity

7/29/08 MMR shot #2 given and dropped off papers at Civil Surgeon (CS)

7/31/08 Picked up I-693, completed by local CS, (I paid $25, don't be fooled)

8/3 - 8/6/08 Worked on forms I-485, G-325A, I-864, I-765 and I-131; sent to Chicago - YESSS!

8/11/08 NOA1 for AOS, EAD and AP; 9/2/08 Transfered to CSC; 9/4/08 Biometrics

10/24/08 Rec'd AP; 10/27/08 Rec'd EAD; 11/24/08 Rec'd GC

I had my medical in January 2008 so it's not expired. As for transcribing the vaccination ... isn't this already with all my medical forms that I surrendered at POE??

Theoretically it was on your DS-3025. Do you have a copy of that? The requirements changed recently for the I-693... Here's a link to the pinned topic. Check out the stuff at the beginning and at the end.

It looks like some people have been submitting just their DS-3025 and not getting RFEs for it and others are (like you).

So... take your DS-3025 to a CS and arm yourself with print outs of all the info below to show the CS (read the end of the pinned topic linked above to see why).
