Timeline

Ive been here in the US for almost 9 monts under K3 visa. I havent filed for my permanet residence or adjustment of status yet. My visa allows me to be here until Oct of 2009. Question: Is there a time line to where i have to file for adjustment of status or permanent residence or can i still wait and file it next year before October?

I need an answer to this pls. Thank u so much.

March '05 - met George online thru common friend

March '06 - He went to visit me in the PI first time

May '06 - He came back for the family reunion and proposed for marriage

Nov. '06 - came back to prepare for our wedding

Dec 16, '06 - Wedding Day!

took at least 6 or 7 months (as i remember) for the K3 and was approved!

Nov '07 - I arrived in the US

together again with my gwapo, lol

April 9 - mailed in AOS package

April 13 - NOA for EAD and AOS

April 22 - Biometrics Appointment and will be on May 7 in Jamaica

May 7 - Biometrics done!

May 14 - Got an RFE dated may 9 - joint sponsor :-(

June 5 - they received our reply to the RFE

June 10 - EAD card production ordered, YAYYYYY Thank u, God!

June 21 - EAD card received in mail.

...and the waiting continues for the interview date...... will update later

so i got my interview date, and guess when??

Sept 10 - yaayyyy and its my hubby's Birthday! Approval would be a GREAT bday gift.

Sept 10 - got APPROVED! Indeed its a GREAT Birthday gift! " Card production Ordered" Yayyy

Sept 18 - Welcome Letter received!

Sept 19 - Green Card in hand!

there is no time limit! hehehe

i wondered the same thing when i got here but i was thinking of doing it after our 2nd year anniversary which will be on feb 2009..i just got here 2 weeks ago...in our case after the 2 years we can still apply for an extension would still be valid...

You actually would want to do it before one year has passed since the date of your medical exam for the K3. If you wait until after that, you'll have to go thru another medical exam here in the US, at additional cost.

divorced - April 2010 moved back to Ontario May 2010 and surrendered green card

Yes, filing the I-485 more than a year after the medical abroad, would require a new medical.

yep! more money out of the pocket!! i had my medical last june and were palnning on submitting on february after our 2nd year anniversary...so im still in the 1 year medical validity! :P

is this for real? correct me if i am wrong but the expiration of the I-94 for K-3 is good for two years only. beyond that, you are considered an illegal alien.

It is for real. The correct term is that one would accrue "unlawful presence". If the couple remains married and later adjusts status, there's no actual penalty. It's similar to the fact there's no penalty for not filing the I-485 before the I-94 for expires for a K1 visa holder.

so is there way to get green card for 10 years since i will have green card for avilable for two years and i will got it befor my 2 anniversary one month
