Hello,

I am applying for Citizenship end of August and I just got a traffic ticket for faliure to obey highway sign. I think the fine is under $200 and my court date is 09/19/08

When I am filling out the form for part 10 for Good Moral Character it asks me if I had:

1. ever been arrested, cited or detained by any law inforcement officer.

2. ever been charged with any crime or offense.

Does this apply to minor traffic ticket or no?

Please let me know. I am sure few ppl might have gotten traffic tickets before.

Tricky topic. Discussed a lot in here. Through the guides, it implies that they don't care about those, and that you don't need any court records or of such if it is under $500. But it doesn't say to leave them out. It also says if you lie on your application your citizenship can be revoked even after it was granted. Were they talking about traffic tickets, doubtful. Anyway we did answer yes to that question, for a traffic ticket. really just to be on the safe side. And now we got a RFE, stating we need the information on the arrest for the interview. What arrest? Oh well, I think it is an automatic process. So we are going to go ahead and get the court records and bring them with us, although I don't think we will need them. Will let the forum know what our Interviewer says about it.

My 2 cents:

Disclose all traffic violations in N400, but make it clear there were no arrest, just citations.

Take certified court disposition reports to the interview although they are not required for non-DUI/DWI violations under $500

In short - be safe than sorry. Traffic violations are no big deal, but does'nt hurt to have the paperwork.

Thanks for the message. That is what I was wondering...just mentioning ticket would create RFE. I wish the instructions were more clearer.

Yes this topic has been beaten to death on another forum and with a lot of questions to IO's and to the INS via the phone line (including my experience) is that you do not have to disclose simple traffic tickets if they are under $500 and did not involve any sort of DUI.

No it is not stated very well if you should or you shouldn't but from the responses from the IO's and the INS they have been saying it is not neccissary.

Now if you have other issues on your N-400, then showing you paid tickets like this might be beneficial if you have had other court cases or issues with other convictions. If you only have traffic tickets then don't bother.

I never disclosed mine, was asked even if I had gone to court before for any reason during my interview. I mentioned yes 2 for traffic fines and was just asked if they were DUI or over $500. Since they weren't he moved on...

Other issues with traffic violations besides the USCIS, get enough negative points and you will lose your license. Your insurance company knows about them and will increase your rates. My gosh, if you got ticketed for not obeying a traffic sign, that cop was looking right at you, didn't you see him? With Homeland Security doubling the number of cops, that is all they have to do is to issue tickets and are all over the place. Have to do a constant 360* view when driving nowadays, they are after you!

My husband just had his interview. He had 2 traffic tickets that we did not include on the application. He asked about them in the interview, and we had the proof of payment and copies of his driving record. The interviewer said she did not care about the tickets, as long as they were not alcohol or drug related.

yes it does. they ask about traffic tickets and even the nimor ones. some people dont mention them some do.
