Maybe my divorce could be why my case under Administrative Review

I think my case is under Administrative Review due to my divorce. My fiancee was grilled pretty good about my divorce...when is my divorce finalize...when did we met...when did I proposed...etc... According my fiancee she noticed that the CO having some facial expression when start looking at my divorce and the dates.

Here is my side...my divorce was filled 05/2006 and finalized 12/31/2007. I submitted the K1 petition 02/25/2008. Maybe the one in questions I'm still legally married while going out with my fiancee.

Is any body out ther in the same situation and still got their visa?

Hi there... I just wanna ask when did you met your fiancee?

My side..I met Derek last week of April 2007 and he was separated early March. He visited me September 9-16,2007 and the divorce was finalized September 11,2007. Apparently he was with me that time in the Philippines. We filed the petition February 11,2008. Over all.... he was still legally married when we first met in person. Thank God I am here in the US now.

The CO didn't even questioned me anything about that way back June 5,2008 in USEM. I can't see anything wrong with your situation. I saw a lot of similar cases with you "AR" lately posted here in VJ..some didn't got any pink or white slip..some were asked to returned in 2nd day... Who knows? perhaps USEM lately is being strict again.

I will be praying with the status of your visa. Hope everything will be fine. As long as the passport wasn't returned thats a good sign.

They shouldnt have a problem with it if you were legally seperated.

11-22-06 She winks at me!!!!!

2-13-07 Fly to MNL

2-14-07 I get there for Valentines Day cause I am sweet like that!

2-20-07 I fly home....

7-10-07 I fly to Manila again before I go to Iraq

7-11-07 Engaged

7-12-07 We go to Tarlac to meet the family and stay there

7-17-07 I go home....

7-24-07 Go to Iraq

2-24-08 I come back from Iraq safe and sound cause I promised I would!

3-25-08 Fly to Manila AGAIN 3rd time on that flight (But it was a little better on Continetal Airlines to Japan cause there coach class has power ports for laptops.

4-22-08 End of the best month ever....even though I had to shower from a bucket like Iraq and buy her an AC cause I was dying at her house....Had to do the visa extension thing which was easy, I had a very good time for the month I was there and felt so much more comfortable about the future!

I am a little curious if that is your hold up cause I suppose I am in the same situation. Me and my ex wife actually seperated in October of 05 when I went to Iraq the first time. The legal Seperation paperwork was put in in January of 07. In North Carolina you have to be separated a year. Our divorce wasnt finalized until May of this year because I was in Iraq again. But I guess when I was technically married but legally separated I went to see Mhay 3 times.

If you could keep us posted on your result so I can plan ahead. I am just brainstorming here and I am sure in 99% of divorces this is just a pipe dream but is it possible you could get your ex to sign something like a letter....Or provide a lease showing you were living alone.

But the CO doesn't know when I separated...and on the divorce decree it doesn't mention when the divorce was submitted. The CO could be just looking at the divorce when it was final.

I'm not being negative here...I'm just looking at the worse case. If this is the case I'm prepared to write a letter to the CO explain my side.

They don't care about divorce as long as you can provide them copy of the decree certified true copy from the court.

Most of the cases under A/R is the delayed response of NSO for the document verification...

I agree with you djazy66.... my hubby and his ex wife separated sept 06 and we met july 07 and met personally nov07 when he's not yet divorced but was on process that time already, it was finalized dec07 and applied k1 feb08.. and my IV went so well just took 5mins and just asked personal background about me and my hubby.... I think really depends with CO.. female Consuls are stricter and ask lots of questions than male CO..

09/30/08 - mailed AOS, AP and EAD thru USPS

10/02/08 - received and signed by V. Bustamante

10/06/08 - check cashed out

10/07/08 - date of NOA

10/08/08 - last touch for AP and EAD

10/28/08 - AOS transferred to CSC

11/04/08 - touched on AOS

11/05/08 - touched again on AOS

11/06/08 - touched again on AOS ( no touch on AP and EAD)

12/08/08 - EAD approved according to USCIS officer (from infopass)

12/09/08 - touched on AP and EAD

12/10/08 - AP approved dated 12/09

12/15/08 - AP on mail

01/12/09 - went to infopass - found out my EAD has been approved since DEC 8,2008

01/21/09 - biometrics appoinment

01/21/09- Card production ordered for I-765 and a touched for I-485

01/22/09 - touched on I-485

01/23/09 - touched again on i-485

01/26/09- touched again on I-485 and i-765! WOW!

01/29/09 - i-765 approval notice sent.. and EAD card received in mail

02/24/09 - AOS APPROVED!! thanks God!

02/25/09 - AOS touched again

02/27/09 - GC and welcome letter received in the mail

The CO who interviewed me didn't know when my hubby was separated too.. Same thing the CO just looked on my hubby's divorced final decree too and the fact that he was with me during that time should be a big questioned too, isn't it?

Always be positive man..everything will be fine. You don't need to explain your side to the CO I believed, unless they want you to do so.

I'm very positive...its my fiancee she is thinking that she was denied...but kept telling her NO! pink slip means approved and white slip slight delay receiving your visa for more documents review. Now she doesn't have appetite to eat all I can do is laugh and trying to comfort her not to worry too much everything is all good.

hi there...hope this will make you feel better....

i met my husband (before my fiance) june 2005...talked more than a year after we decided to meet personally...after 3 personal meeting...we decided to apply for the visa...and when he requested for his divorce papers...theres no divorce decree....and when checked what happened his ex wife didnt sign the divorce paper...so he applied for another divorce paper july 2007....we got the final paper sept 2007 and filed the application oct 2007 as his State states that he cant be married within 30days...and the requirement is both should be legally able to marry.....so my interview experience? yes i was grilled also about that......after asking me alot of questions he paused for like 1 minute and said 'okay' then i thought im done but to my surprise..he start asking questions again....and this this its about his past marriage.....he saw that we met june 2005 and ben together sept2006, may2007 and sept2007 and yet the divorce paper was finalized sept 2007? yeah that would be questionable for them.....because they dont know...so i explained to them the story.....i thought he would be satisfied already but not he still have alot of questions like ' is he still married when you were dating?' is he still living with his wife that time?' how sure are you that hes not with his wife?' how long are they separated?' how long the marriage last?' and to my surprised even our religion....hahahha.....oh well.....as long as you know you are telling the truth it will not be a problem...im sure its the document verification is what holding you...i waited 1month before they released my visa...but all i can say is.....its all worth it....just be patient and never stop trusting God...He will give it to you..in His time... ;)

Questions for the U.S. Citizen should be reserved for the U.S. Citizen. No one would be more aware of the details of the divorce than the U.S. Citizen him(her)self.

Other than the circumstances leading up to my divorce from my Xwife, Sweetie knows nothing more than the dates of the divorce. Talking about my previous marriage simply did not dominate our conversations.
