I-864 & OF-230 questions...

Hi all!

Well we got pack 3 containing the I-864, so of course we have a few questions!

Firstly, the instructions say that I (beneficiary) have to fill out an OF-230 (Part 1) - surely they mean DS-230??? I can't even find document OF-230! Can anyone help on that?

OK, onto the I-864.

1. My wife (petitioner), has a full time job here in the UK, as I do. She's leaving her job at the end of this month, and flying back to TX middle of September. I'm staying back till the house sells. So... with regard to the poverty guidelines, does she state that she is in full time work (she's filling the form out today), and also, does she fill in her current address as the one in the UK?

2. My wife's mom is sponsoring me too, so at the top of the form where you have to check only one box, does my wife check the "I am the petitioner", or "I am the first of two joint sponsors" ?

3. Can my wife include her current salary as income, bearing in mind she leaves this job in 2 weeks?

Sound like a typo on the DS-230, never heard of the other form either.

Not sure on 2 but for 1 and 3, no your wife's current income doesn't count because it will not continue in the USA, plus it won't exist anymore by the time your interview happens.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Hi Anthony

This is based on research, not experience (you're still a week or so ahead of us!) but:

OF-230: A google suggests that OF-230 is the old name for DS-230 and you should be OK with the latter.

2: Your wife ticks box (a), your MiL ticks box (d).

I'm pretty sure that Penguin is right on 1 and 3, but ISTR reading something about how you're meant to put in your current employment but then show zero for income, or something. Can't find the reference right now though.

So.. does she put her address as here in the UK? Like I said she's still here for another 4 weeks...

The DS-230 looks pretty straight forward (except all the places i've lived since i was 16!!!!)... look forward to your reply, and of course will keep updating!

Places lived since 16 is what we got a RFE for as my wife missed a month!

Wife needs an address in the US.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

!! ALL PAU!

For the I-130 we put my USC husband's Irish address, as you need to be resident in the country to do DCF, and in all future papers we listed him as resident at his sisters in the US.
