Why are there still some fliers from last year waiting and at the same time fliers who recently applied already getting approved??

Why isn't everyone following the processing times....I'm guessing those who have waited a very long time may have other circumstances such as mistakes in filing or needing further info or issues w/ their application info. Or are there a few who've done everything correctly and are still waiting for much longer than 6 months? Any explanations?

And at the same time, can anyone explain how fliers of less than 3 months are getting approved? What's the secret? Are they going out of order?

Those are all very good questions. I don't think there is an answer unfortunately. At least I don't have one. It seems like Vermont transferred alot of older CR-1 petitions to California. Also, it seems like California is approving NEW I-130s in about 2 weeks. As far as filing mistakes, I doubt that is the case. USCIS claims to have a FIFO policy, but it is obvious they don't adhere to that policy. Looking at your time line, you seem to be in the same boat I am, but a month or so behind me. So my only advice is to keep monitoring the progress here on VJ. Trying to make any sense of USCIS, and in what order the will process petitions, will more than likely have you in an asylum in no time bouncing off rubber walls. Sorry I couldn't be of more help. Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)

I filed an I-130 in November of 2007 and it took more than 7 months for Vermont to approve and forward to the National Visa Center. Once our I-130 was in the NVC, it only took about 4 weeks to be sent to the Embassy in Belgrade, Serbia. There were absolutely no delays in our processing because of missing forms or documents. Extremely frustrating. Our interview is scheduled for September 30th - Praise the Lord. I wish you the best of luck and hopefully you won't have to wait forever like many of us. And I know, there are others who have been waiting longer than I have been.

I'll tell you, I don't think anyone can really answer those questions. USCIS is really screwed up. That is probably the best reason to give. Roughly a year ago at this time, VSC was doing what CSC is doing now, approving new I129F and I130s in 4 weeks or so. CSCers waited 6 months or more. Now things have reversed course, its the other way around. Right now, if you applied to CSC, you would expect approval in September, while VSC February filers are still waiting.

On top of that, for a short while (from March 2007), they approved both I129F and I130 together, but only sent the I129F to NVC. The I130 was stored for later AOS. Essentially they forced you down the K3 road. This was bad for us. We wanted both applications working at once. At our embassy, the K3 and CR1 interviews are scheduled at about the same wait time (3-4 months). I129F would have flown through NVC, gotten us an interview date in 3-4 months. I130 case would have been completed in those 3-4 months (if all went well), and we would try to use the already scheduled K3 interview for the CR1 instead of having to wait another 3-4 months. Then they started administratively closing I129Fs when they approved the I130 at the same time (especially at VSC), forcing people down the CR1 path, which some people were not happy about. Now they have return to letting both petitions continue on.

How much sense does this all make? Where is the logic at USCIS? Hard to say. That is just the tip of the iceberg here. :wacko:

that is the question that has been bugging me all these months. and there is no answer to that because we are at the mercy of the uscis, they think they can do what they want, when they want, how they want it. bottomline is that uscis people are inconsiderate slobs.. especially VSC

I don't think that's true.

There are THOUSANDS of cases to work through and more coming in everyday. They're all stuffed into storage because there are just not enough officers to work on them, and not enough time to counter-balance the amount still coming in. No one is sitting at their desk with a pile of cases, choosing not to work, and laughing at the stupid foreigners having to wait... it's just that there are THAT many people trying to move to the US to be with their family.

I'm a VSC filer too and I hate that the centres have reserved and that we're now looking at a much longer wait. However, not long ago it was CSC that had to wait and not too many VSC filers were complaining then; just relieved that it wasn't them... and now California has been sped up because more officers were employed, people are just complaining about Vermont. They're doing everything they can. Being bitter about the officers isn't going to do anyone any good, just give you more stress. Just tell yourself that your case is IN their pile and will be worked on as soon as possible.

I have been waiting almost 6 months since I filed my I-130. It's kind of frustrating to see someone come along and file in July, and get approved in 2-3 weeks. It really doesn't matter that CSC was waiting longer before, and VSC was quicker. The point is, this process should be somewhat equal. It is not. If it takes 3 months at CSC, it should take 3 months at VSC. It's hard to just sit back and say "My case is in their pile." Get back to me in December when 50 people that filed after you have been approved, and then tell me "They're doing everything they can." I doubt you will have the same attitude.

I was talking to the poster above that claimed people working at USCIS "think they can do what they want, when they want, how they want it" and that they were "inconsiderate slobs". If you want to blame the system, fair enough because it does indeed suck. But I don't believe that the individuals working on cases are ruthless for the sake of it.

I agree with you that the wait should be equal at both service centres but unfortunately that's not the case, and it's been a recurring pattern. A fall in approvals is due round about now and will speed up over the coming months.

I understand why you must be feeling frustrated and obviously you're more than welcome to rant about it. I've seen many people around here that are on a 6 month wait, some that are on a 12 month wait, and many that don't know why others are being approved before them. But don't jump on me because I'm a new filer; I have my own frustrations too. I'd been waiting just to send my file off since June but circumstances meant that I had to wait another 2 months... in those 2 months, the wait for approval at VSC has almost doubled while I could do nothing but sit back and watch it, and I don't expect my petition to reach the consulate any time this year.

There's nothing else that I, or any of us can do except know that our approvals are all going to come and that the number of them will increase shortly.
