When is our status changed?

Timeline

I have TN visa, which allows me work in US as Canadian and my daughter has TD visa, can study but can not work here.

Now my daughter got admitted by a US college as A internaional student, not resident even we live here more than 1 year.

The college thinks she is TD visa holder, does not consider her as a dependent of my husband (Legale guardian, her step-farther) even we filed Tax Return together.

Is there any regulation/law to state that, after we got NOA for I-130/I-485/I-751, or got EAD, our visa would be expired as pending status adjustment?

If so, would you please help me find the link so that I can show to the college?

From our experience, until the GC (permanent resident) card is in hand, most universities will consider the student as an international (some may still charge higher rates until the student has had their residence/GC a year or longer). :thumbs:

Really, that is unfair to us. I work here and pay tax and ym daughter has to pay out-status tuition?
