no tax returns filed because im a full time student

Hi there,

Well hopefully the N-400 goes off next week, my question is since becomming a permanent resident, i haven't filed any tax returns because i've been a full-time student, and my wife has unfortunately been unemployed,

So how do i explain this on the N-400 when it is something that they really want???

do i write a basic attachment letter stating why? does it have to be notorized? what do i do???

Oct 29th 2004 -Met online
Oct 29th -First phone call
Dec 25th -She purposed and i said Yes!
May 10th I-130 Packet and Packet 3 sent off to me by the U.S. Consulate
May 16th -Received Packets 1-3 from the U.S. consulate
June 29th -I arrived in Puerto-Rico!
July 2nd -Married in Mayaguez, Puerto-Rico and also got our interview date for September 6th
August 17th -We arrived in Australia to file for Sep. 6th
September 6th - Filed DCF in Sydney and approved 1 hour later!
September 12 -Received my passport with the visa and yellow packet
November 24th -POE.......Guam,USA
December 12, 2005-Green Card arrived in the mail
September 11, 2007 -Filed I-751 on conditions
September 17 -VSC Receives my I-751 and issues NOA1
Oct 10 -Had biometrics taken in San Juan, Puerto Rico ASC
Oct 12 -Touched.
Aug 21, 2008 -Approved!...........finally
Sep 17, 2008 -Mailed off N-400
Oct 22, 2008 -Biometrics taken in San Juan ASC
Feb 12, 2009 -N-400 Interview
Feb 26, 2009 -Oath.....the end.

In your situation I would include a letter stating why you have not filled taxes. And I would prove I got the money I lived on since becoming a LPR. For example, if you received financial aid send them copies of your financial aid award letters. If you lived off savings, show proof of that with past bank statements. I don't have any experience filing a N-400...just my thoughts. Hope this helps.

I don't think you would need to have that letter notarized, but you could since most banks offer it for free to their members.

Hi Aussielad,

I had a similar problem too, about not having any tax returns for the I-751. Basically, I'll send (in the next 3 days) them a noted attachment and other evidence supporting it, saying as to why I/we didn't file tax returns. Did you encounter the same problem when you filed for your I-751 too? What did you do then? If you had the note/attachment for that, it would probably work the same way for the N-400 too. By the way, did you ever get your 10yr Green Card yet? Don't worry about it having notarized, as the immigration officers can probably look into these things themselves (I'm sure they have a way to do it). But if doubtful, get them notarized, just in case.

Probably you can get IRS statement for not filing the tax return using following form.

But I'm curious how you manage your financial situation.

If you get some paycheck through part-time, you may have to file the tax return even if you are full time student.

Otherwise, you may have some proof of following.

1) you are student during the period

2) how you manage the finanacial situation - financial aid from parents or scholarship ? -

3) summarized statement that you were not required to file tax return per IRS regulation ( probably notarized? )

You don't have to include tax returns. Typically, it's the easiest form of proving the marriage, but it's not required. You can include copies of leases, bank statements, etc as evidence of your marriage.

FOr the question of whether or not you are current in your filing of tax returns, you can check the yes box if your income was not more than the filing requirement.

we live off my student loans, thats why, and her dad gives her like $250 a month so thats why i didnt file one, cos i technically dont make any money, neither does she....

So i dont have to file any tax returns or send in anything???

I didn't say that.. you do have to submit evidence of your relationship, but tax returns are one of the choices... they are not a requirement for the N-400. Other evidence such as bank statements, lease copies, etc. is acceptable.

You don't get an RFE for an N-400... Everything is taken care of at the interview. Tax returns are NOT required for an N-400. They are merely one form of evidence on the relationship. You can use other evidence to establish your marital union. Please refer to the N-400 checklist on the USCIS website. You'll see what I am talking about.
