Could you please help me to fill part 5 according to my particular situation:

Sponsor’s I-864

Part 5. Sponsor's household size.

Persons you are sponsoring in this affidavit:

Persons NOT sponsored in this affidavit:

b. Yourself………………………………………………………………………………………………….1 (is that correct?)

c. If you are currently married, enter "1" for your spouse………………………………………………….1 (I am married to beneficiary I am sponsoring, should I put 1 here?)

d. If you have dependent children, enter the number here………………………………………………….1

e. If you have any other dependents, enter the number here………………………………………………..0

f. If you have sponsored any other persons on an I-864 or I-864 EZ

who are now lawful permanent residents, enter the number here………………………………………….1 (I have sponsored my ex husband 9 years ago and he is full time working 8 years already, should I still include him? If no, how should I prove that I am not sponsoring him anymore )

What will be total number for me in that case?

The instructions say you should only count each person once. So for Part 5, c. you should put 0. In the margin you can write "my spouse is the beneficiary and is already counted above in item a."

Did you sponsor him? Yes.

Is he a LPR? Yes.

Per the 864 you filed for him previously you are obligated to abide by the conditions until one of several things happends to him:

Your obligation to support the immigrant you are sponsoring

in this affidavit of support will continue until the sponsored

immigrant becomes a U.S. citizen, or can be credited with 40

qualifying quarters of work in the United States.   Although 40

qualifying quarters of work (credits) generally equates to 10

years of work, in certain cases the work of a spouse or parent

adds qualifying quarters toward eligibility.   The Social

Security Administration can provide information on how to

count qualifying quarters (credits) of work.   The obligation

also ends if you or the sponsored immigrant dies or if the

sponsored immigrant ceases to be a lawful permanent resident

and departs the United States.   Divorce does not end the

sponsorship obligation.

Bottom line you have to count him.

don't entered 1 on this item, if you entered 1 that means you already count your wife two times.
