HUGE PROBLEM

hello everyone,

i am new to this forum but i have been reading it since i startes my AOS back in NOVEMBER 2007. my case has been going through some difficulties and the last one i am having is unexplainable. first my AOS interview is scheduled for SEPTEMBER 4TH which makes it less than 3 weeks from today. let me give you a quick idea of my casem hoping that some of you have been going through the same steps and have been hitting the same obstacles.

- got married on august 2007

- applied for AOS on nov 2007

- received RFE for NSEERS registration for I-485, on december 2007

- done biometrics on dec 2007

- my lawyer responded stating that i dont have proof of NSEERS registration, and requesting that i be scheduled for one.

- received RFE for nseers registration for I-765, on january 2007

- same response sent again for the I-765 RFE as for the I-485

- received a NOTICE OF INTENT TO DENY for both the I-485 and I-765, with an appointment set for an interview with ICE in order to determine compliance with NSEERS registration, scheduled for MAY 13, 2008

- appeared as scheduled on MAY 13, 2008 for ICE interview. couldnt be done because MISSOURI sent the wrong file to ICE. officer rescheduled me for MAY 28, 2008.

- appeared on may 28th, interview was fine. been asked background questions, photographed and fingerprinted. wrote on the I-94 the NSEERS registration number and told me to make sure to show it to the IO on the day of the AOS interview to prove that i complied with NSEERS registration

- replied to USCIS with a copy of the I-94, case was updated and resumed for I-485 but online update for I-765 never changed.

- received interview letter on july, scheduled for sept 2008

- placed service request for I-765, as being out of processing times cos i havent heard anything since i sent a copy of my i-94.

-august 13th, received response from USCIS to the service resquest, saying that my I-765 was DENIED on JUNE 21ST NO DENIAL LETTER EVER RECEIVED BY ME OR MY LAWYER AND NO ONLINE UPDATE.

what a story right!!!!. i never received neither me nor my lawyer any denial letter, which first make me unaware of the reason for the denial while i am 3 weeks shy of being interviewed for my green card. my lawyer doesnt have any idea either, and when i called USCIS, all they could do is to place another service request asking for a copy of the denial letter which will take 45 days to process, i am sure i will know way after the day of my interview.

WELL THAT'S ABOUT IT, I DONT KNOW WHAT TO EXPECT NOW, AND DONT KNOW IF THIS WOULD AFFECT MY INTERVIEW. 11 MONTHS INTO THE PROCESS AND NOTHINNNGG. WHY???? I DONT KNOW!!!!.

I HOPE I CAN FIND SOMEONE EHO HAS THE SAME EXPERIENCE, AND PLEASE SHARE ANY ADVICE.

MY FAITH IS IN GOD THE ALMIGHTY, HE GIVES AND TAKES NOT USCIS.

There's few countries that undergo NSEERS registration and as what the ICE officer told you, you MUST bring the I-94 with NSEERS registration that he wrote on your AOS interview date. Which you should've gotten in your Port of Entry in the first place but you have not. For now, relax and gather all everything that you have passed with your AOS and most especially that NSEERS registration on your I-94. Good luck and God bless you

hey what was ur status when u went for ur NSEERS registration. I got the same RFE but the problem with me is that i m out of status and going to ICE means getting arrested and deported.
