My fiance's interview is next Tuesday (Aug 19, 2008). Today is the 14th and he still has not received the packet of documents for his interview sent by our attorney. I contacted the attorney's assistant on the 4th of August informing her that the packet needs to arrive by the 11th because my fiance was heading to Rio and staying until the interview is completed. She assured me she was mailing it out that same day (Aug 4th). When she told me she was using DHL to send the documents, I told her that DHL doesn't go directly to my fiance's location. They have to use a secondary carrier once in Rio and this could take up to an additional 10 days. I told her FedEx delivers to his location in 2 days. Her response: We don't have an account with FedEx. #######???? Open one!!!

Well the 11th came and went and my fiance stayed an additional two days. He left for Rio this morning (14th) without the packet from the attorney and will have his medical in the morning.

I haven't trusted my attorney since the day he received my payment in full due to other issues with his office. Thank God I anticipated a problem and sent my fiance the documents well over a month ago.

Since the attorney completed the DS-156 online, I asked her on August 4th to email me the document. I printed it and FedEx'd it to my fiance on the 5th along with some other loose ends. He received it the morning of the 8th.

You don't specify what was in the "packet of documents" from the attorney versus the documents that you sent your fiance a month ago.

If there's still something missing that the attorney's office hasn't gotten out there, you can establish your own FedEx account (they offer personal ones) and give the number to the girl in the office.

Or, call another attorney, and tell him that you want him to call your original attorney and suggest legal action if Original Attorney doesn't comply with the necessities before the interview. Think of the liability if your fiance is turned down at the embassy because of missing information that was still in the attorney's office... or which was in transit when it should have been in your fiance's hands!

Your course of action is up to you.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Good luck on your interview, really.

The attorney was a complete and total waste of time and money and no doubt delayed the whole process by weeks or months. NO ONE, no matter how much you pay them has more interest in your case than YOU! Using ANYONE else to do ANYTHING will only cause delays. In fact it is IMPOSSIBLE for an attorney to do anything except fill in a few simple forms. YOU have to give all the documents, provide all the evidence, everything. I did not use an attorney and look at my timeline! And we could have had our interview a month earlier but my fiancee was not able to due to her business schedule. I had everything for "packet 3" complete before our NOA2 and the DAY, THE DAY, the embassy received our case, I scheduled the interview appointment. I brought everything myself to the interview and we got our visa no questions asked. And the BS that attorneys give about the USCIS borders on slander! I never had one problem with anyone from USCIS or the Consulate and they were always helpful.
