Hello fellow VJers.

Does anyone know whether K1 visa holder can work in the U.S. without employment authorization stamp?

I was reading Social Security Administration page and it said that K1 holders are allowed to work without employment

authorization.... Is it true? It said that I-94 (even the one without work authorization stamp) is an evidence that K1 holders can work in the U.S. Since I-94 expires in 90 days, we lose rights to work in 90 days.... I guess it is why we apply for work authorization card upon AOS....

I am really really confused.....

Does anyone know anything about this?

Unfortunately, an I-94 is not necessarily work authorisation.

I-94's are also issued to temp-worker dependents such as TD (dependent of TN-1), H-4 (H1-b's dependent), O-3 (of O-1), R-2 (of R-1)--all of which are not work-authorised (among TD's particularly, this is a point of much cribbing).

However, it is true that K-1's (with work-auth stamp) are work-authorised (for the 90-day period of the K-1).

I-94 for K1 is not work authorization.

There are those who will argue that simply a valid I-94 (from K-visa) is enough to allow an employer to hire the holder. In reality it doesn't really matter since there are virtually no employers who will do so, even WITH a Temp EAD stamp.

Yes - that's why we file for EAD and could be why the process only takes about 70-90 days ..

You bring up another very important point; even the people who come through JFK and get an authorization stamp, can only work for as long as the I-94 is valid, which is 90 days from the date of entry, and only after they have obtained a SSN, which takes about two weeks after entry!

They would then have to stop working, until either they receive their EAD or their GC.

As everyone stated above, you need EAD to work in US :blush: . Actually, when you get SSN card with K-1, "with DHS work authorization only" is printed on the card :whistle: . If you want to work before GC, better to file EAD with AOS. (EAD filing fee is free if you file with AOS) :thumbs:

They can work as soon as they get here, but it won't be legal without the stamp or EAD card. :whistle:
