Hello,

We are so close to being finished with the K-1 visa process and now I am just trying to prepare for the aos after math. I already have his absentee application for our marriage license and I am planning on making an appointment with the justice of the peace as soon as I know when my fiance is going to be here. My first question is about applying for ssn.

Why do I need to do this prior to the green card and how do I do it?

Second the AOS package I keep seeing people writing about, where do I get it, or what does it consist of so that I can get ready to send everything in once we are married?

Finally I want to apply for his work authorization, do I send this in with the first AOS package, and is there anything special I need , forms etc, that I need to fill out for the work authorization?

You do not need SSN to file for AOS.

NOTE: K-1 is not a work visa, it is a fiancee visa for entry to the USA and marriage, K-1 is "Work Auth" primarily to be able to get the SSN, some states are strict in their interpretation of a federal law that requires persons applying for a "license" to have SSN, this can cause a problem with marriage license if only one person has SSN and the other (the K-1 holder) does not.

AOS = Adjustment of Status, the package is what you put together and send to USCIS to adjust status:

Yes you apply for EAD Work Auth at the same time as AOS.

SSN is not required before working... it is optional. Some people think having one makes life easier

I-485 is AOS form... find it and read the instructions. Will answer many questions.

I-765 is the interim EAD application.. find it and read the instructions... pretty simple form

I don't think you actually need to get an SSN for immigration purposes before getting a green card---in fact, our local Social Security office just told my husband he can't get one until he has a green card. But you will find it difficult (if not impossible) to do things like refinance the mortgage, apply for credit cards, or get a driver's license. One of the posters on the Canada branch needed a Social Security Number to get a library card (I'm not sure if that's common or not). It's kind of a de facto national ID number.

As far as what to send for AOS, you can find all the forms on line. If you click the link at the top of VJ for "downloads" you will find a section for AOS downloads. Fill in those forms and also print out the directions for them to see what evidence you need to send along with them. And yes, you send the EAD (work authorization) form in along with the rest of the AOS. It is form I-765, and you want to make sure the bottom of the form says it is the 5/27/08 edition because that is the only one they are accepting.

You also might want to read the AOS guides before you start. That can also be found by going to a link at the top of VJ.

Go back to SSA and demand the SSN, K-1 can apply for one within 75 days of entry, you are within that period.
