EAD before AOS

Timeline

Question:

Coming thru JFK my fiance - now husband got his temp EAD for 3 months...can I apply for the EAD before I mail our application for AOS...I just need some more time to get all the docs for the AOS...can that be done? We already have SS#...any advice welcomed...thank you all

As he already has a temp EAD valid for 90 days the only other EAd you can apply for is with or after you have filed for AOS.... If he is already working he will have to give up work when his 90 day EAD expires as it can not be renewed....

The quick answer is unfortunately no.

The EAD has to be based on something and it will be based on the application to adjust to permenant residency. The original 90 day stamp that he got at JFK cant be extended.

It sucks and you will hear many times that people need to be able to get one quicker because of the gap between employment authorization but it is a bad situation that many of us find ourselves in and there is nothing that can be done about it.

Just get the AOS applied for as soon as possible

Could you explain further? As a person entering on a K-1 visa they are allowed to work for the validity period of their I-94 which is 90 days. As they already have the stamp to do so this need not be applied for. For people who dont get this stamp they may apply for an EAD for the 90 day validity of the I-94 but as this process takes around 90 days it is not generally worth it.

So if you could explain further what eligibility category you think they should be applying under im sure that would be very helpful

gee, sorry, I misread the info, I thought he was K3. Which wouldn't make sense now that I reread the OP. Reeeeeeeeeeeeally sorry for that, I was just a bit tired there for a moment and confused it with K3 procedure.

Thank you all for your responses...I will be sending my AOS and EAD applications today so I guess we will take it from there...my husband is currently working and I hope that we will be able to get at least the Infopass appointment on the 91st day as I have seen some people do...I guess time will show how it all will unfold...thank you all for your input...Dorothy
