Hi,

I urgently need an advise. I have a green card interview next week through marriage. My American wife has changed her mind and she is not going to go to the interview. What am I going to do? Also, I already had travel plans to visit my country next month. So, if I re-schedule the interview and go to my country, will my Advance Parole still allow me to come back to the states? How about my work permit, will it be revoked, if I reschedule it? Thank you...

Yes, you will be able to come back to the states. If you reschedule, this will only mean that your waiting time will be prolonged and you will be given a different date but both the EAD and AP will be still valid.

Just out of curiosity, you are just trying to buy more time to stay in this country right? Since your american wife has refused to go to the interview, this means she is not willing to sponsor you and a divorce may be possible, am I wrong? Well, if that's your intention I guess is possible since you will be waiting for a second interview, but if things don't work out between your wife and at the end you don't show up for the 2nd interview, it will be as if you abandoned your AOS and you will have to return to your home country.

I wouldn't worry about your plans to go home or your work permit. If your wife refuses to attend the AOS interview you're facing deportation~

From what I have read in this forum, you can go to the AOS interview by yourself. As long as you prove that your marriage was bona fide to begin with you may still get approved. Somebody else did that and I think was approved.

You'll have to do a search for the thread and I wouldn't know where to begin.

I have never heard of that for the conditional greencard, only for VAWA petitions or the removal of conditions application.

On second thought, that may have been for removal of conditions, not the initial interview for greencard.
