NVC is making me lose my mind - 2nd RFE on I-864?

OK, basically we flew through all the first steps at the NVC. Then this happened:

July 26: The I-864 packet was received by NVC.

August 2: I express mailed DS-230

When I came home from mailing that, the NVC automated system message said that we had an RFE on the I-864.

August 4 (The following Monday): I called and an operator said it was because they wanted an employment letter from me. I have a joint sponsor and had submitted everything possible EXCEPT the employment letter, but whatever.

August 6: I sent the RFE response (generated a proper barcoded cover sheet and everything)

Sometime after this, the automated system recognized first that the DS-230 was in the system and then that the RFE response had been received. I called operators to confirm several times. They said they had everything. All looked good.

August 11: Automated system AGAIN starts saying my documents have been reviewed and they found information missing on my financial evidence. "A checklist letter has been mailed on August 11"

August 12: Same message, but now they say "A checklist letter has been mailed on August 12" WHAT?!?

I called several times both today and yesterday, and each operator asks "Have you sent in the proof of employment letter?". Yes! I have! What scares me is that before they were saying they had this info in the system, and now they're asking me if I've sent it! I finally agreed to have a supervisor review our packet, but I'm scared that's going to slow it down even more! The NVC claims they just need time to review the paperwork, which I'd be fine with if they could at least confirm that they HAVE the paperwork, but they can't.

Have they lost part of my file? Should I just re-send the entire I-864 packet? Fortunately I have a total duplicate...

Or should I just figure this new RFE message is an error and sooner or later, if I leave everything alone, we'll have our case completed?

Long story short, we have a complicated case. We've been at this for nearly 5 years. You can read our story here. I highly recommend our attorney Laurel Scott, as well as attorneys Laura Fernandez and Lizz Cannon .

Filed I-130 via CSC in Feb 2008. Petition approved June 2008. Consular interview in Mexico, Oct 2008, visa denied, INA 212a6cii. We allege improper application of the law in this case.

2012, started over in Seoul: I-130 filed DCF on 7/2, I-130 approved 8/8, Medical at Yonsei Severance 11/20, IR1 appointment in November 2012.

CRBA filed 1-3-13 at Seoul for our daughter

I understand what you are saying because we pretty much experienced the same thing.

We had an RFE for the DS-230. I called the operator when I heard the message and she said I had missed putting 'to present' in a couple of fields. I called again and spoke to another operator who confirmed this.

I made up the cover sheet etc etc - sent it overnight to NVC. A few days later the message changed, saying they had received the item.

So a week or so passes - no case complete - hmmm. I get the hard copy of the RFE - they did want the corrected DS-230 but they ALSO wanted a photo copy of my Husband's Canadian PR card (he is the beneficiary and inteviewed in Canada).

The thing is - first of all I don't think the operators can see everything we send - things that are out of the ordinary they may not see - there is no 'code' for a Canadian PR card and there is no code, probably, for an 'employment letter' - therefore they can't really tell you whether it is there or not.

Anyway, don't want to make this posting too long, but in a nutshell I ended up having to email a copy of his PR card twice and overnight a hard copy.

I then had to get a supervisor involved. She said 10-14 days but it was really only like 5 or less - she was very nice (I had to call her back a second time as, although they assured her they were going to work on the file - they didn't and she had to go over there to see them a second time).

I have a theory about this - I think they frown on people making their own RFE coversheets - I can't remember who it was a month or so ago who tried Chris Parker's RFE coversheet and his file ended getting hung up as well.

So basically 3 things:

1. The operator may not have told you all that was missing.

2. I think they frown on people creating their own RFE coversheets.

3. Let the supervisor take care of it, I definately would not submit anything else, until it is requested. If you did not personally speak with a supervisor today, call back and ask to speak to one yourself.

(Oh and I also had the shifting dates thing for the 2nd RFE for the card and I also had many operators tell me to ignore the message - they had everything they needed with the corrected DS-230 - hence my belief that they can't see all that is missing - or requested).

THANK YOU for sharing your experience. I feel better. :) I actually got the hard copy of the RFE several days after sending in my employment letter and that was all they wanted, so I'm definitely sure I submitted the evidence they needed. Hopefully the supervisor will be able to review and complete our case quickly.

Yes, I called and spoke with an NVC operator, briefly explained the situation and then asked to speak with a supervisor.

Why would you purposefully ignore a clearly stated RFE? Isnt that asking for trouble and delays? Make multiple copies to prepare to supply it again if necessary, but I wouldnt ignore anything and expect a good outcome.
